<strong>Birds</strong> <strong>in</strong> <strong>the</strong> <strong>European</strong> <strong>Union</strong>, published by <strong>BirdLife</strong><br />

<strong>International</strong> marks <strong>the</strong> 25th anniversary of <strong>the</strong> EU <strong>Birds</strong><br />

Directive (79/409/EEC). Us<strong>in</strong>g <strong>the</strong> most recent data, <strong>the</strong><br />

effectiveness of <strong>the</strong> Directive has been assessed, and knowledge<br />

gaps as well as challenges for <strong>the</strong> future have been identified.<br />

This assessment shows that <strong>the</strong> <strong>Birds</strong> Directive has been<br />

successful <strong>in</strong> protect<strong>in</strong>g some of Europe’s threatened species<br />

when properly implemented and backed by plans and resources.<br />

Evidence that <strong>the</strong> Directive works <strong>in</strong>cludes:<br />

■ EXECUTIVE SUMMARY<br />

Overall, <strong>the</strong> population trends of Annex I species were more<br />

positive than non-Annex I species between 1990–2000.<br />

The analysis revealed that <strong>the</strong> populations of Annex I species<br />

<strong>in</strong> <strong>the</strong> EU15 did better than <strong>the</strong> same species <strong>in</strong> non-EU15<br />

between 1990–2000.<br />

Significant progress has been made through <strong>the</strong><br />

implementation of Species Action Plans (SAP) for species<br />

such as Z<strong>in</strong>o’s Petrel, Pterodroma madeira and Dalmatian<br />

Pelican, Pelecanus crispus.<br />

Annex I species with a Species Action Plan did better than<br />

those without a SAP <strong>in</strong> <strong>the</strong> EU15, <strong>in</strong> <strong>the</strong> period 1990–2000.<br />

The almost complete coverage of <strong>the</strong> species with SAPs by<br />

<strong>the</strong> Special Protection Area (SPA) network is suggested as<br />

a key reason why <strong>the</strong>se species fare better <strong>in</strong> general when<br />

compared to o<strong>the</strong>r Annex I species.<br />

The <strong>Birds</strong> Directive has been successful by almost completely<br />

elim<strong>in</strong>at<strong>in</strong>g <strong>the</strong> trade of wild birds, which is illegal accord<strong>in</strong>g<br />

to its provisions, across <strong>the</strong> EU.<br />

Cases brought before national or EU courts have been<br />

successful not only <strong>in</strong> clarify<strong>in</strong>g important aspects of <strong>the</strong><br />

Directive, but also to help solv<strong>in</strong>g conflicts between<br />

conservation and development.<br />

The <strong>Birds</strong> Directive, however, does not work <strong>in</strong> isolation and<br />

<strong>the</strong> overall picture for birds does not look so positive. In<br />

particular, <strong>the</strong> analysis revealed:<br />

The Conservation Status of birds has deteriorated <strong>in</strong> Europe,<br />

although with<strong>in</strong> <strong>the</strong> EU <strong>the</strong> overall situation did not change<br />

<strong>in</strong> <strong>the</strong> last 10 years.<br />

There is a higher proportion of species with Unfavourable<br />

Status with<strong>in</strong> <strong>the</strong> EU25 than at <strong>the</strong> Pan-<strong>European</strong> level.<br />

Farmland birds are still <strong>in</strong> steep decl<strong>in</strong>e at <strong>the</strong> EU and on<br />

Pan-<strong>European</strong> level, a trend that is l<strong>in</strong>ked to <strong>in</strong>creased yields<br />

driven, with<strong>in</strong> <strong>the</strong> EU, by <strong>the</strong> Common Agricultural Policy.<br />

The SPA network <strong>in</strong> <strong>the</strong> EU15 is unfortunately ra<strong>the</strong>r<br />

<strong>in</strong>complete when compared to Important Bird Areas<br />

identified by <strong>BirdLife</strong> <strong>International</strong> (only 44% of IBA area<br />

is covered by SPA classification). There is a strong difference<br />

though between <strong>in</strong>dividual countries and between regions<br />

<strong>in</strong> terms of SPA classifications.<br />

The status of Annex II species (which can be hunted) has<br />

worsened. A total of 36 species out of 79 (46%) on Annex II<br />

have Unfavourable Conservation Status at EU25 level and a<br />

total of 31 (39%) have <strong>the</strong> same status at <strong>the</strong> Pan-<strong>European</strong><br />

level.<br />

Long-distance migrants are decl<strong>in</strong><strong>in</strong>g at an alarm<strong>in</strong>g rate.<br />

Most of <strong>the</strong>se changes are l<strong>in</strong>ked to damag<strong>in</strong>g land use policies,<br />

such as <strong>the</strong> Common Agricultural Policy (CAP). The root cause<br />

of <strong>the</strong> crash <strong>in</strong> migratory bird populations is not known, but it<br />

is likely that it cannot be expla<strong>in</strong>ed by actions <strong>in</strong> <strong>the</strong> EU alone.<br />

However, <strong>the</strong> slow rate of classification of <strong>the</strong> most valuable<br />

sites as SPAs is clearly a responsibility of <strong>the</strong> EU Member States,<br />

many of whom are still delay<strong>in</strong>g unreasonably this all-important<br />

issue.<br />

It is also noted <strong>in</strong> <strong>the</strong> assessment that a major omission <strong>in</strong><br />

<strong>the</strong> exist<strong>in</strong>g EU nature legislation is <strong>the</strong> protection of <strong>the</strong><br />

outstand<strong>in</strong>g bird diversity of <strong>the</strong> EU’s tropical outermost<br />

regions, <strong>the</strong> French departments of French Guiana,<br />

Guadeloupe, Mart<strong>in</strong>ique and Réunion Island. These territories<br />

toge<strong>the</strong>r hold a bird fauna that is richer than <strong>the</strong> whole of<br />

Europe, with eight globally threatened and 13 near-threatened<br />

species. The application of some of <strong>the</strong> EU’s policies and<br />

budgets <strong>in</strong> <strong>the</strong>se territories, without adequate legislative<br />

safeguards for <strong>the</strong> protection of biodiversity, can spell doom<br />

for <strong>the</strong>se species.<br />

For <strong>the</strong> next 25 years, <strong>BirdLife</strong> has <strong>the</strong> follow<strong>in</strong>g<br />

recommendations for streng<strong>the</strong>n<strong>in</strong>g <strong>the</strong> implementation of <strong>the</strong><br />

Directive <strong>in</strong> order to improve <strong>the</strong> Conservation Status of birds<br />

<strong>in</strong> <strong>the</strong> EU:<br />

Full implementation of all provisions of <strong>the</strong> <strong>Birds</strong> and<br />

Habitats Directives across all EU Member States.<br />

Full <strong>in</strong>tegration of <strong>the</strong> provisions of <strong>the</strong>se Directives <strong>in</strong> o<strong>the</strong>r<br />

EU policies, like CAP, transport, regional development,<br />

energy and o<strong>the</strong>rs.<br />

Classification of all IBAs as Special Protection Areas (SPAs)<br />

<strong>in</strong> <strong>the</strong> EU.<br />

Consideration of <strong>the</strong> list of species with Unfavourable<br />

Conservation Status <strong>in</strong> this publication <strong>in</strong> possible future<br />

reviews of <strong>the</strong> Annex I list of <strong>the</strong> <strong>Birds</strong> Directive.<br />

Full implementation, <strong>in</strong>clud<strong>in</strong>g f<strong>in</strong>anc<strong>in</strong>g, of <strong>the</strong> Species<br />

Action Plans.<br />

Ensur<strong>in</strong>g adequate and targeted EU co-fund<strong>in</strong>g for nature<br />

conservation measures with <strong>the</strong> “LIFE Nature” (or an<br />

equivalent) <strong>in</strong>strument and updat<strong>in</strong>g <strong>the</strong> list of priority<br />

species for this fund<strong>in</strong>g, tak<strong>in</strong>g <strong>in</strong>to account <strong>the</strong> results of<br />

this review.<br />

Cont<strong>in</strong>uation and streng<strong>the</strong>n<strong>in</strong>g of control of illegal trade<br />

of wild birds <strong>in</strong> order to elim<strong>in</strong>ate all occurrences across <strong>the</strong><br />

EU.<br />

Completion, implementation and assessment of <strong>the</strong> species<br />

management plans for all Annex II species with<br />

Unfavourable Conservation Status and cooperative work<br />

to reverse those trends.<br />

Monitor<strong>in</strong>g systems set <strong>in</strong> place by <strong>the</strong> Commission and<br />

Member States to provide necessary <strong>in</strong>formation concern<strong>in</strong>g:<br />

– Effective delivery of <strong>the</strong> nature directives aga<strong>in</strong>st <strong>the</strong>ir<br />

overall goals.<br />

– The contribution to broader biodiversity conservation<br />

objectives with<strong>in</strong> <strong>the</strong> EU.<br />

– Effective delivery of SPAs aga<strong>in</strong>st <strong>the</strong>ir objectives (e.g.<br />

through identification of targets and site specific<br />

<strong>in</strong>dicators for all SPAs).<br />

Promotion and support of:<br />

– Research <strong>in</strong> order to set basel<strong>in</strong>es, targets and <strong>in</strong>vestigate<br />

network coherence.<br />

– Development of predictive modell<strong>in</strong>g for <strong>the</strong> effect of<br />

issues like climate change on biodiversity.<br />

– Gap analysis and prioritisation.<br />

– Research on habitat management requirements.<br />

Use of <strong>the</strong> <strong>in</strong>dicators suggested by <strong>BirdLife</strong> <strong>International</strong><br />

for monitor<strong>in</strong>g common birds, sites and threatened birds <strong>in</strong><br />

Member States’ regular reports to <strong>the</strong> <strong>European</strong> Commission<br />

every three years.<br />

Development of special legislation to protect birds and o<strong>the</strong>r<br />

wildlife <strong>in</strong> <strong>the</strong> biodiversity rich outermost regions of <strong>the</strong> EU.
