of life-sustaining medical treatment. Some of the principles and procedures are:<br />
There must be a uniform approach and process to withholding or<br />
withdrawing life sustaining medical treatment in all health care<br />
instituti<strong>on</strong>s.<br />
The decisi<strong>on</strong>-making process must be clear and transparent and must<br />
be communicated clearly not <strong>on</strong>ly to the patient and his or her family<br />
but also to the public in order to facilitate a broad understanding of how<br />
these decisi<strong>on</strong>s are made.<br />
Emphasis must be placed <strong>on</strong> the process for decisi<strong>on</strong>-making rather<br />
than the formulati<strong>on</strong> of specific rules which would purport to dictate the<br />
decisi<strong>on</strong>. The process must be designed to facilitate an agreement<br />
between the physician and the patient or his or her substitute decisi<strong>on</strong>maker.<br />
Where there is disagreement between the physician and the patient or<br />
substitute decisi<strong>on</strong>-maker <strong>on</strong> the appropriate course of acti<strong>on</strong>, the<br />
patient must be given an opportunity to secure an independent sec<strong>on</strong>d<br />
opini<strong>on</strong> from a physician who is not a member of the patient‟s health<br />
care team and/or request that his or her care be transferred to another<br />
willing physician.<br />
The Commissi<strong>on</strong> did not favour a right to indefinite life-sustaining<br />
medical treatment. The appeal of aut<strong>on</strong>omous decisi<strong>on</strong>-making and<br />
pers<strong>on</strong>al c<strong>on</strong>trol of all end-of-life medical decisi<strong>on</strong> making is initially<br />
attractive, but an unfettered right to life-sustaining treatment may result<br />
in unreas<strong>on</strong>able demands being made for indefinite inappropriate<br />
medical treatment.<br />
Final resort to the courts will remain available where the procedures<br />
designed to achieve c<strong>on</strong>sensus have irretrievably broken down. 110<br />
(2) Final recommendati<strong>on</strong>s<br />
2.46 The Manitoba <strong>Law</strong> <strong>Reform</strong> Commissi<strong>on</strong> did not favour a legislative<br />
implementati<strong>on</strong> of these principles. Rather:<br />
“[i]ts preference is to see them embodied in a statement or by-law of<br />
the College of Physicians and Surge<strong>on</strong>s of Manitoba…We also<br />
recommend that other health care instituti<strong>on</strong>s, agencies, associati<strong>on</strong>s<br />
and bodies involved in delivering health care in Manitoba should<br />
adopt the policy of the College <strong>on</strong>ce amended to reflect our advice.<br />
