Lashed
out over
lack of
manners
by Kezia Buckley
A 24-year-old alcoholic
woman has pleaded guilty
to assaulting a woman in
Selby, after she moved her
bicycle out of the way for
her and received no 'thank
you' in return.
Jenna Rhodes, who lives in
Pontefract, was walking with
her bicycle through Selby on
Saturday, October 20, last
year, when she assaulted
Claire O'Hara in the
European Food Shop in
Gowthorpe.
Ms Rhodes, pleaded guilty
to the offence at Selby
Magistrates' Court on
Thursday, January 10.
Sandra White, solicitor for
the Crown Prosecution
Service, said: "At about 8pm
the complainant Claire
O'Hara was walking with
friends into Selby town for a
night out, when she decided
to go into a shop to purchase
some cigarettes. As she
reaches the shop she noticed
the defendant approaching
her pushing a bike. As she
passes by, the defendant then
shouts at Ms O'Hara and says
'a thank you wouldn't go a
miss'. Ms O'Hara then went
into the shop and stood in the
queue and was waiting to be
served when Ms Rhodes
followed her in and started
kicking off and having a go at
her about manners and
saying a thank you was
required."
CCTV footage of the
assault was then shown in
court to the magistrates,
which showed Ms Rhodes
lashing out at hitting Ms
O'Hara in the face with the
back of her hand.
Mrs White, prosecuting
said: "After Ms Rhodes hit
Ms O'Hara, her friend
intervenes by standing
between them. Ms Rhodes
then continues to shout
aggressively, threatening her
saying she will wait for her to
come outside. Ms O"Hara
had no idea why she had
been assaulted, she didn't say
anything or do anything to
provoke her."
A member of the probation
service who spoke on her
behalf said that she was
drunk at the time and only
remembers parts of the
incident as she often drinks
up to ten cans a day.
She said: "Ms Rhodes lacks
consequential thinking and
cognitive skills and she was
very honest in interview and
said that she would not do
unpaid work and would
rather go to prison. Therefore
I would recommend a
supervision order is made."
Keith Haggerty, defending
her said: "Her previous
record shows a young lady
which has had a lot of alcohol
related problems for many
years. In a very polite way
she moved her cycle out of
the way and when she was
ignored by the victim that
annoyed her.
"She is adamant that for all
her troubles and faults, she
was always taught to be
polite and to have manners.
"In this case, the camera
does not lie. I would describe
the assault as more a flick
with the back of her hand
rather than a punch. She is
not proud of this and she has
made serious efforts to try
and control her drinking
issues. I would hope her
punishment is reflected
adequately."
Hilary Gilbertson, chairing
magistrate, said while
passing sentence: "The
probation service has given
us a very helpful report and
Mr Haggerty has told us of
your complicated life. You
have made efforts to cope
with your alcohol problem
therefore we have drawn
back from custody because
we feel you need help and
support. Most people do use
the manners you felt the
victim didn't but your self
control should have stopped
you from going into the shop
and acting aggressive for a
period of time, which caused
alarm to her. The
compensation you will pay is
a token to her."
Magistrates sentenced her
to a 12-month supervision
order, with the condition of
attending a thinking skills
course and ordered her to
pay £50 compensation to the
victim for causing alarm and
distress.
