Lashed<br />
out over<br />
lack of<br />
manners<br />

A 24-year-old alcoholic<br />
woman has pleaded guilty<br />
to assaulting a woman in<br />
Selby, after she moved her<br />
bicycle out of the way for<br />
her and received no 'thank<br />
you' in return.<br />
Jenna Rhodes, who lives in<br />
Pontefract, was walking with<br />
her bicycle through Selby on<br />
Saturday, October 20, last<br />
year, when she assaulted<br />
Claire O'Hara in the<br />
European Food Shop in<br />
Gowthorpe.<br />
Ms Rhodes, pleaded guilty<br />
to the offence at Selby<br />
Magistrates' Court on<br />
Thursday, <strong>January</strong> 10.<br />
Sandra White, solicitor for<br />
the Crown Prosecution<br />
Service, said: "At about 8pm<br />
the complainant Claire<br />
O'Hara was walking with<br />
friends into Selby town for a<br />
night out, when she decided<br />
to go into a shop to purchase<br />
some cigarettes. As she<br />
reaches the shop she noticed<br />
the defendant approaching<br />
her pushing a bike. As she<br />
passes by, the defendant then<br />
shouts at Ms O'Hara and says<br />
'a thank you wouldn't go a<br />
miss'. Ms O'Hara then went<br />
into the shop and stood in the<br />
queue and was waiting to be<br />
served when Ms Rhodes<br />
followed her in and started<br />
kicking off and having a go at<br />
her about manners and<br />
saying a thank you was<br />
required."<br />
CCTV footage of the<br />
assault was then shown in<br />
court to the magistrates,<br />
which showed Ms Rhodes<br />
lashing out at hitting Ms<br />
O'Hara in the face with the<br />
back of her hand.<br />
Mrs White, prosecuting<br />
said: "After Ms Rhodes hit<br />
Ms O'Hara, her friend<br />
intervenes by standing<br />
between them. Ms Rhodes<br />
then continues to shout<br />
aggressively, threatening her<br />
saying she will wait for her to<br />
come outside. Ms O"Hara<br />
had no idea why she had<br />
been assaulted, she didn't say<br />
anything or do anything to<br />
provoke her."<br />
A member of the probation<br />
service who spoke on her<br />
behalf said that she was<br />
drunk at the time and only<br />
remembers parts of the<br />
incident as she often drinks<br />
up to ten cans a day.<br />
She said: "Ms Rhodes lacks<br />
consequential thinking and<br />
cognitive skills and she was<br />
very honest in interview and<br />
said that she would not do<br />
unpaid work and would<br />
rather go to prison. Therefore<br />
I would recommend a<br />
supervision order is made."<br />
Keith Haggerty, defending<br />
her said: "Her previous<br />
record shows a young lady<br />
which has had a lot of alcohol<br />
related problems for many<br />
years. In a very polite way<br />
she moved her cycle out of<br />
the way and when she was<br />
ignored by the victim that<br />
annoyed her.<br />
"She is adamant that for all<br />
her troubles and faults, she<br />
was always taught to be<br />
polite and to have manners.<br />
"In this case, the camera<br />
does not lie. I would describe<br />
the assault as more a flick<br />
with the back of her hand<br />
rather than a punch. She is<br />
not proud of this and she has<br />
made serious efforts to try<br />
and control her drinking<br />
issues. I would hope her<br />
punishment is reflected<br />
adequately."<br />
Hilary Gilbertson, chairing<br />
magistrate, said while<br />
passing sentence: "The<br />
probation service has given<br />
us a very helpful report and<br />
Mr Haggerty has told us of<br />
your complicated life. You<br />
have made efforts to cope<br />
with your alcohol problem<br />
therefore we have drawn<br />
back from custody because<br />
we feel you need help and<br />
support. Most people do use<br />
the manners you felt the<br />
victim didn't but your self<br />
control should have stopped<br />
you from going into the shop<br />
and acting aggressive for a<br />
period of time, which caused<br />
alarm to her. The<br />
compensation you will pay is<br />
a token to her."<br />
Magistrates sentenced her<br />
to a 12-month supervision<br />
order, with the condition of<br />
attending a thinking skills<br />
course and ordered her to<br />
pay £50 compensation to the<br />
victim for causing alarm and<br />
distress.
