Madrid Protocol Seminar
On March 13, following the suggestion
of NetPremium Seguros, one of our
member companies, SWISSCAM Rio held a
meeting at the National Trade Confederation
(CNC), where eleven guests representing
different entities and companies discussed
the various economic aspects related to
Brazil’s eventual signature of the Madrid
Protocol. The protocol is a legal document
that regulates international trademark and
patent registration, and has already been
signed by 78 countries.
The seminar was opened by Dr. Andréia
Gomes, a lawyer with Tozzini, Freire, Teixeira
& Silva Advogados, who introduced to the
audience Brazilian and foreign subject-matter
specialists on this topic of great relevance
for international trade.
Jane Collins (Syngenta, Switzerland) and
Gerhard Bauer (DaimlerChrysler, Germany)
explained the simplicity, the savings, and the
safety provided by trademark registration
under the Madrid Protocol, and their remarks
were in line with the views of Dr. José Graça
Aranha, director of WIPO (World Intellectual
Property Organization).
Fernanda Falcão from Innova, a Brazilian
company, called the audience’s attention to
the high cost involved in trademark registration
in the countries that have not signed the
protocol, and admitted that the cost/benefit
ratio is not always favorable. Marcelo Peviani,
from Editora Abril, which ranks fourth in the
global ranking of weekly magazine publishing,
also defends adhesion to the protocol
and agrees it is necessary to facilitate the
registration process and improve the international
perception of our country.
Luiz Henrique do Amaral and Gabriel
Leonardos, from Dannemann, Bigler, and
Momsen, Leonardos, respectively, mentioned
the fact that Brazil might not be ready to
sign the protocol due to the slow and more
complex political procedures that will have
to be followed to meet the terms of the
protocol. They also pointed out to the six
years it takes to register a trademark with
the INPI (National Institute of Intellectual
Property) as a critical factor.
Palestrantes - Speakers: Bauer, Peviani,
Machado, Collins, Falcão, Gomes, Aranha,
Amaral, Ávila, Leonardos, Temporal
SWISSCAM Rio
Jorge Ávila, vice-president of INPI and moderator
in the first panel, stated that the institute
would soon begin using the new computerized
trademark registration system.
He highlighted the possibility of requesting
registration online, thus eliminating paper registration.
As the team of reviewers will
triple, the situation is expected to get under
control by the end of 2007. He is confident
that the country and its agencies will be able
to deal with the consequences resulting
from signature of the Madrid Protocol.
FIRJAN was represented in the meeting by
Dr. Amaury Temporal, who performed his
role as moderator of the second panel with
brilliance and wit.
Also present was Dr. Eduardo Machado,
from Montaury Pimenta, Machado & Lioce,
who was kind enough to provide us with
support to organize the event.
