Madrid Protocol Seminar<br />
On March 13, following the suggestion<br />
of NetPremium Seguros, one of our<br />
member companies, SWISSCAM Rio held a<br />
meeting at the National Trade Confederation<br />
(CNC), where eleven guests representing<br />
different entities and companies discussed<br />
the various eco<strong>no</strong>mic aspects related to<br />
Brazil’s eventual signature of the Madrid<br />
Protocol. The protocol is a legal document<br />
that regulates international trademark and<br />
patent registration, and has already been<br />
signed by 78 countries.<br />
The seminar was opened by Dr. Andréia<br />
Gomes, a lawyer with Tozzini, Freire, Teixeira<br />
& Silva Advogados, who introduced to the<br />
audience Brazilian and foreign subject-matter<br />
specialists on this topic of great relevance<br />
for international trade.<br />
Jane Collins (Syngenta, Switzerland) and<br />
Gerhard Bauer (DaimlerChrysler, Germany)<br />
explained the simplicity, the savings, and the<br />
safety provided by trademark registration<br />
under the Madrid Protocol, and their remarks<br />
were in line with the views of Dr. José Graça<br />
Aranha, director of WIPO (World Intellectual<br />
Property Organization).<br />
Fernanda Falcão from In<strong>no</strong>va, a Brazilian<br />
company, called the audience’s attention to<br />
the high cost involved in trademark registration<br />
in the countries that have <strong>no</strong>t signed the<br />
protocol, and admitted that the cost/benefit<br />
ratio is <strong>no</strong>t always favorable. Marcelo Peviani,<br />
from Editora Abril, which ranks fourth in the<br />
global ranking of weekly magazine publishing,<br />
also defends adhesion to the protocol<br />
and agrees it is necessary to facilitate the<br />
registration process and improve the international<br />
perception of our country.<br />

Leonardos, from Dannemann, Bigler, and<br />
Momsen, Leonardos, respectively, mentioned<br />
the fact that Brazil might <strong>no</strong>t be ready to<br />
sign the protocol due to the slow and more<br />
complex political procedures that will have<br />
to be followed to meet the terms of the<br />
protocol. They also pointed out to the six<br />
years it takes to register a trademark with<br />
the INPI (National Institute of Intellectual<br />
Property) as a critical factor.<br />

Jorge Ávila, vice-president of INPI and moderator<br />
in the first panel, stated that the institute<br />
would soon begin using the new computerized<br />
trademark registration system.<br />
He highlighted the possibility of requesting<br />
registration online, thus eliminating paper registration.<br />
As the team of reviewers will<br />
triple, the situation is expected to get under<br />
control by the end of 2007. He is confident<br />
that the country and its agencies will be able<br />
to deal with the consequences resulting<br />
from signature of the Madrid Protocol.<br />
FIRJAN was represented in the meeting by<br />
Dr. Amaury Temporal, who performed his<br />
role as moderator of the second panel with<br />
brilliance and wit.<br />

from Montaury Pimenta, Machado & Lioce,<br />
who was kind e<strong>no</strong>ugh to provide us with<br />
support to organize the event.
