21. São inúmeros os casos emblemáticos de criminalização,<<strong>br</strong> />nos quais se estabelece uma emaranhada<<strong>br</strong> />relação de racismo e conivência entre os poderes,<<strong>br</strong> />especialmente o Poder Judiciário, como no caso de<<strong>br</strong> />Kurusu Ambá: “As lideranças estão sendo criminalizadas<<strong>br</strong> />e uma delas teve que deixar sua comunidade,<<strong>br</strong> />buscando segurança. Neste local houve prisões de<<strong>br</strong> />várias lideranças desde 2007, quando quatro delas<<strong>br</strong> />foram condenadas a 17 anos e meio de reclusão.<<strong>br</strong> />Foi um processo relâmpago, que desde o inquérito<<strong>br</strong> />até a condenação levou apenas sete meses, quando<<strong>br</strong> />casos envolvendo assassinatos de lideranças indígenas<<strong>br</strong> />levam dezenas de anos para serem concluídos<<strong>br</strong> />ou simplesmente prescrevem, como é o caso do assassinato<<strong>br</strong> />de Marçal de Souza Tupã’i. Um indicador<<strong>br</strong> />dessa agilidade de condenação indígena são os mais<<strong>br</strong> />de 200 índios nos presídios do cone sul do Mato<<strong>br</strong> />Grosso do Sul, o maior número de indígenas encarcerados<<strong>br</strong> />num estado no país.” (CIMI, 2010).<<strong>br</strong> />22. O tekohá é o lugar físico - que inclui a terra, o<<strong>br</strong> />mato, o campo, as águas, os animais, as plantas, os<<strong>br</strong> />remédios - onde se realiza o teko, o “modo de ser”,<<strong>br</strong> />o estado de vida guarani.<<strong>br</strong> />23. O Conselho Nacional de Justiça, recentemente<<strong>br</strong> />relatou que só na Federação da Agricultura<<strong>br</strong> />e Pecuária de Mato Grosso do Sul - FAMASUL<<strong>br</strong> />existem quase 20 ações judiciais que visam paralisar<<strong>br</strong> />e/ou impactam o processo de demarcação das<<strong>br</strong> />terras indígenas, dever este imposto pela Constituição<<strong>br</strong> />Brasileira.<<strong>br</strong> />24. Como exemplo recente, em 22 de junho de<<strong>br</strong> />2015, cerca de 50 mem<strong>br</strong>os da comunidade Kurusu<<strong>br</strong> />Ambá ocuparam uma nova área dentro de seu<<strong>br</strong> />território tradicional que engloba a sede da Fazenda<<strong>br</strong> />Madama. A reação a esta ocupação por parte<<strong>br</strong> />dos fazendeiros da região foi, mais uma vez, marcada<<strong>br</strong> />por ações extremamente violentas: no dia 24<<strong>br</strong> />de junho de 2015, 40 caminhonetes chegaram à<<strong>br</strong> />sede da Fazenda Madama e tomaram a área à força.<<strong>br</strong> />Fazendeiros armados dispararam tiros em direção<<strong>br</strong> />aos homens, mulheres, crianças e idosos que se encontravam<<strong>br</strong> />no local e atearam fogo com óleo diesel<<strong>br</strong> />nos barracos das famílias. A ação dos fazendeiros,<<strong>br</strong> />“(...) foi precedida por uma reunião na sede do Sindicato<<strong>br</strong> />Rural de Amambai (MS), com a presença de<<strong>br</strong> />representantes da Federação dos Produtores Rurais<<strong>br</strong> />do Mato Grosso do Sul (Famasul), do vice-prefeito<<strong>br</strong> />de Amambai, Edinaldo Luiz Bandeira, do vereador<<strong>br</strong> />e presidente da Câmara Municipal do município,<<strong>br</strong> />Jaime Bambil Marques, e comandantes das polícias<<strong>br</strong> />Militar e Civil. Tonico Benites, antropólogo<<strong>br</strong> />Kaiowá e um dos mem<strong>br</strong>os da coordenação da organização<<strong>br</strong> />Aty Guasu, conta que, após a reunião, as<<strong>br</strong> />caminhonetes seguiram para a sede da fazenda, sob<<strong>br</strong> />o pretexto de que iriam retirar seus rebanhos de<<strong>br</strong> />lá.” Instituto Socioambiental (ISA). Disponível em:<<strong>br</strong> />http://www.socioambiental.org/<strong>pt</strong>-<strong>br</strong>/noticias-<<strong>br</strong> />-socioambientais/apos-retomadas-de-terras-por-<<strong>br</strong> />-indios-fazendeiros-atacam-acampamento-guarani-kaiowa-no-sul-de-ms.<<strong>br</strong> />Acesso: Julho de 2015.<<strong>br</strong> />A omissão do Estado em regularizar a situação destes tekohás 22 – e<<strong>br</strong> />de outras terras indígenas no Mato Grosso do Sul – a<strong>br</strong>e espaço<<strong>br</strong> />para que inúmeras demandas judiciais venham a ameaçar e lesar<<strong>br</strong> />os direitos originários indígenas, que passam a ser tratados como<<strong>br</strong> />“ameaça” ao direito de propriedade individual, o qual está sendo<<strong>br</strong> />exercido ao arbítrio da Constituição da República Federativa do<<strong>br</strong> />Brasil 23 . No período de elaboração deste resumo executivo, por<<strong>br</strong> />exemplo, foram consultados os autos relativos a quatro (4) ações<<strong>br</strong> />contrárias aos direitos da comunidade de Guaiviry que tramitam<<strong>br</strong> />perante a Justiça Federal, três (3) interditos proibitórios e uma ação<<strong>br</strong> />de reintegração de posse.<<strong>br</strong> />É igualmente importante registrar que o clima de medo e hostilidade<<strong>br</strong> />é relatado constantemente pelas três comunidades. Recentes<<strong>br</strong> />e violentos ataques a estas comunidades confirmam como<<strong>br</strong> />o poder político e econômico local seguem se articulando, sem<<strong>br</strong> />qualquer pudor e sem qualquer receio de virem a ser punidos<<strong>br</strong> />pelos atos criminosos que cometem contra os Guarani e Kaiowá<<strong>br</strong> />no Mato Grosso do Sul 24 . A impunidade histórica chancela esses<<strong>br</strong> />ataques, que surgem sempre que qualquer ação dos Guarani e<<strong>br</strong> />Kaiowá de reivindicação de seus direitos previstos na Constituição<<strong>br</strong> />Federal é realizada.<<strong>br</strong> />Os pedaços de terras que estas comunidades ocupam dentro de<<strong>br</strong> />seus territórios tradicionais estão dominados por monoculturas das<<strong>br</strong> />fazendas, cujo cultivo demanda o uso excessivo de agrotóxicos e<<strong>br</strong> />de outros produtos que representam grave risco à sua saúde, à sua<<strong>br</strong> />vida, representando também uma violação aos seus demais direitos<<strong>br</strong> />humanos, como o direito humano à alimentação e à nutrição e o<<strong>br</strong> />direito humano à água.<<strong>br</strong> />As péssimas condições de vida enfrentadas pelas crianças, idosos e<<strong>br</strong> />idosas, mulheres, homens e jovens destas três comunidades, comprovadas<<strong>br</strong> />pela pesquisa realizada em 2013, revelam a dimensão e a<<strong>br</strong> />gravidade das violações aos seus direitos humanos.<<strong>br</strong> />20
