Que pontos apontaria como cruciais na NR-12, que
mudaram o panorama da segurança nas empresas para os
funcionários?
A NR-12 em sua construção tripartite procurou trazer a informação
já consagrada em segurança de máquinas ao alcance
de toda a sociedade, em seu conteúdo estão os fundamentos
basilares e que podem ser aplicados pelos micro e pequenos
empresários que muitas vezes não tem informação suficiente
e empregam com dificuldade seus recursos em máquinas que
poderiam estar oferecendo riscos aos trabalhadores. De posse
das informações básicas de segurança estes empresários podem
passar a observar e exigir máquinas adequadamente seguras
valorizando assim o seu investimento. Da mesma forma que
adequações de máquinas ficam facilitadas com as informações
constantes nos diversos anexos da NR-12. Todas estas condições
podem ser acompanhadas pela representação dos trabalhadores
se refletindo em condições de trabalho mais seguras.
Como coordenadora da NR-12, o que aponta de benefícios
gerados pela norma?
A NR-12 foi publicada em 2010, portanto já se passaram
quase seis anos após a sua criação. Acredito que o maior legado
da NR-12 é a difusão do conhecimento sobre proteção de máquinas.
A NR-12 tem conceitos que estão na literatura técnica
há mais de 100 anos, outros remontam à década de 70 e que, se
empregados, evitariam milhares de acidentes mutilantes. Além
do parque fabril obsoleto, ficamos por diversas décadas incorporando
máquinas novas que não correspondiam ao estado
da técnica da época de sua fabricação, isto é, máquinas novas
com concepção obsoleta sob o ponto de vista da segurança,
aumentando cada vez mais o volume de máquinas obsoletas
e perigosas.
Com a informação trazida pela NR-12, empregadores, trabalhadores,
fabricantes e técnicos passaram a se familiarizar com
a boa técnica e hoje os conceitos técnicos presentes na NR-12,

What are the crucial points in NR-12 that have changed
the landscape of worker safety in industrial companies?
NR-12 in its tripartite construction sought to bring the
information already consecrated in machinery safety within
the reach of all Society. It contains the basic fundamentals
of what could be carried out by micro and small entrepreneurs,
who often do not have enough information and who
have difficulty adapting machinery resources, which could
be offering risks to workers. In possession of this basic safety
information, these entrepreneurs can begin to observe
the Standard and require adequately safe machines, thus
valuing their investment. In the same way, machinery adaptations
are made easier with the information contained in
the various annexes to NR-12. All these conditions may be
monitored by worker representatives as they reflect on safer
working conditions.
As NR-12 Coordinator, what are the benefits generated
by the standard?
NR-12 was published in 2010, so it's been almost six years
since its creation. I believe that the greatest legacy of NR-
12 is the dissemination of knowledge about machinery protection.
NR-12 has concepts that have been recorded in the
technical literature for more than 100 years, others date back
to the late 70’s and that, if employed, would prevent thousands
of mutilating accidents. In addition to the industrial
park, for several decades the regulation has remained obsolete,
incorporating “new” machines that did not correspond
to the state-of- the-art at the time of its manufacture, i.e.
new machines with obsolete design from the point of view
of safety, increasing the volume of obsolete and dangerous
machines.
With the information contained in NR-12, employers,
workers, manufacturers and technicians began to familiarize
themselves with good working techniques and the technical
concepts today presented in NR-12, which are mostly the
same concepts as expressed in international technical standards,
are consolidated, where each actor increasingly tends
to see a machine not only within its productive characteristics,
but also within its safety aspects in all its uses.
Many complain that, to meet the standard, it is necessary
to completely renovate the whole industrial park.
Do you agree with this statement?
In our Country, the purpose of economic order is to ensure
dignity to all, under the dictates of social justice, observing,
amongst other things the principle of the social function of
property – Article 170, Paragraph III of the Federal Constitution
of 1988 – in this way, it is up to the entrepreneur to
handle the risks involved in any economic activity, whether
it is harmful to the environment or to the worker. The legal
determination that machines are appropriate and have the
devices required to prevent accidents at work has existed since
1943. The need for adaptation is going to depend on how
much has become outdated over the last seven decades.
