The design considerations <strong>and</strong> proposed process for incorporating recreational uses into<br />

new railroad projects presented in this report are for generic application only <strong>and</strong> intended as<br />

conceptual tools to be utilized by recreational or trail advocates, state agencies <strong>and</strong> host<br />

railroads to identify <strong>and</strong> consider possible applications <strong>of</strong> public access along active rail lines.<br />

No specific right-<strong>of</strong>-way, train frequencies or speeds are assumed. In addition, this report<br />

does not consider potential financial <strong>and</strong>/or political constraints, or legal <strong>and</strong> liability issues<br />

related to the development <strong>of</strong> trails along operating railroad ROW. However, the report does<br />

discuss in general <strong>Virginia</strong>’s l<strong>and</strong>owner liability law, <strong>Virginia</strong> Code §29.1-509, <strong>and</strong> compares<br />

to other states with similar provisions.<br />

Contents<br />

This report is divided into two sections.<br />

Section 1 introduces the purpose <strong>of</strong> the report <strong>and</strong> involved stakeholders.<br />

Section 2 outlines a course <strong>of</strong> action to plan, develop <strong>and</strong> construct an RWT/PC or other<br />

recreational access facility. The process by which a trail advocacy group may submit a<br />

Letter <strong>of</strong> Interest for a trail proposal is outlined. DCR <strong>and</strong>/or DGIF will coordinate with DRPT<br />

<strong>and</strong> the host railroad to assess the feasibility <strong>of</strong> the trail proposal for new Commonwealth<br />

supported railroad projects. This section also lists other useful resources for the development<br />

<strong>of</strong> RWT/PCs.<br />

<strong>Appendix</strong> A is a technical memor<strong>and</strong>um that reviews possible design considerations for the<br />

development <strong>of</strong> RWT/PC projects. Additional research is presented regarding other states’<br />

processes, policies <strong>and</strong> regulations regarding RWT/PCs, liability, safety <strong>and</strong> trespass issues.<br />

The appendix also summarizes the types <strong>of</strong> users likely to use the RWT/PC <strong>and</strong> general<br />

considerations for their safety <strong>and</strong> enjoyment <strong>of</strong> the RWT/PC facility. Finally, the appendix<br />

provides technical design considerations for RWT/PC trail facilities.<br />

Summary<br />

This document was developed as a response to HB2088 <strong>and</strong> should be used as a common<br />

resource for state agencies, railroads, <strong>and</strong> trail advocates for arriving at a consensus on trail<br />

<strong>and</strong> railroad use. This report establishes a process for RWT/PCs project interface <strong>and</strong><br />

development. The design considerations presented in this report (as <strong>Appendix</strong> A) should not<br />

be considered design guidelines, st<strong>and</strong>ards, or specifications. This report provides technical<br />

considerations <strong>and</strong> suggested practices to use as a starting point in the development <strong>of</strong><br />

these types <strong>of</strong> facilities.<br />

The Commonwealth assumes no liability in the use or application <strong>of</strong> the information<br />

presented in this report.<br />
