The National Trails System Act (16 U.S.C. §§ 1241-1251, October 2, 1968 as<br />
amended 1976, 1978-1980, 1983, 1984, 1986-1988, 1990, 1992, 1993, <strong>and</strong><br />
1996)<br />
This Act created a national system <strong>of</strong> trails that continues to provide for the<br />
outdoor recreation needs <strong>of</strong> the United States’ exp<strong>and</strong>ing population as well as<br />
promote the preservation <strong>of</strong> <strong>and</strong> access to outdoor areas <strong>and</strong> historic resources.<br />
The system consists <strong>of</strong> national recreation trails, national scenic trails, national<br />
historic trails, <strong>and</strong> connecting or side trails. The Act designates 19 national scenic<br />
trails <strong>and</strong> national historic trails.<br />
The National Parks <strong>and</strong> <strong>Recreation</strong> Act <strong>of</strong> 1978 (16 U.S.C. 1242-1243)<br />
Established a number <strong>of</strong> national historic trails which cross public l<strong>and</strong>s.<br />
Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy<br />
for Users <strong>of</strong> 2005 (SAFETEA-LU)(23 U.S.C. §§ 206)<br />
This Act provides flexible funding from the Federal Highway Administration that<br />
may be used by States <strong>and</strong> localities for projects on any Federal-aid highway,<br />
including the national highway system, bridge projects on any public road, transit<br />
capital projects, <strong>and</strong> intra-city <strong>and</strong> intercity bus terminals <strong>and</strong> facilities. It builds<br />
on the 1998 Transportation Equity Act for the 21 st Century (TEA-21). The most<br />
relevant concept is that SAFETEA-LU provides matching funds for trails <strong>and</strong><br />
paths that connect to or support transportation-related elements such as<br />
sidewalks, bike lanes, historic railroad depots, <strong>and</strong> transportation museums. The<br />
Act also allocates funds for the <strong>Recreation</strong>al Trails Program which develops <strong>and</strong><br />
maintains trails for recreational purposes that include pedestrian, equestrian,<br />
bicycling <strong>and</strong> non-motorized snow activities as well as <strong>of</strong>f-road motorized vehicle<br />
activities.<br />

This section <strong>of</strong> the code includes requirements for erosion <strong>and</strong> sediment control<br />

outlined in the <strong>Virginia</strong> Erosion <strong>and</strong> Sediment Control H<strong>and</strong>book <strong>and</strong> reviewed by<br />
local <strong>and</strong> State erosion <strong>and</strong> sediment control programs.<br />
