These documents contain the controls and policies that express the <strong>Council</strong>’s objectives for<br />
future development within Appian Way. Where any inconsistencies arise, this DCP will<br />
override <strong>Council</strong>’s Code for Single Dwelling Houses.<br />
5.1.1 <strong>Burwood</strong> Planning Scheme Ordinance (BPSO)<br />
The <strong>Burwood</strong> Planning Scheme Ordinance (BPSO) is the governing planning<br />
instrument for the subject <strong>area</strong>. It establishes clear planning controls for permissible<br />
development within the Appian Way. The content of this DCP incorporates more<br />
detailed guidance for use by persons wishing to carry out development. The policies<br />
of this DCP do not override the provisions of the BPSO, but are complementary to<br />
their intent.<br />
Clause 79A of the BPSO aims to ensure permanent protection of the <strong>area</strong> known as<br />
the “Appian Way Precinct”. The Plan also aims to conserve and enhance the historic,<br />
architectural, landscape and streetscape elements, which contribute to the distinctive<br />
character and unique environment of the “Appian Way Precinct”.<br />
The heritage related planning parameters for development within the Conservation<br />
Area are included in Clause 79A of the BPSO. These provisions of the BPSO were<br />
gazetted as part of Local Environmental Plan (LEP) No. 10.<br />
