<strong>Threat</strong> <strong>Abatement</strong> <strong>Plan</strong> - Invasion <strong>of</strong> native plant communities by Chrysanthemoides monilifera<br />
Prior to these amendments bitou bush and boneseed were declared noxious in all designated<br />
coastal councils/control areas <strong>of</strong> New South Wales (including metropolitan Sydney). These<br />
declarations have remained under the new classification system and amended listings that came<br />
into force on 1 March 2006 (see Appendix 1).<br />
2.2.2 <strong>NSW</strong> <strong>Threat</strong>ened Species Conservation Act<br />
In January 1996 the <strong>NSW</strong> <strong>Threat</strong>ened Species Conservation Act 1995 (TSC Act) commenced to<br />
conserve threatened species, populations and ecological communities in New South Wales. The<br />
objectives <strong>of</strong> the TSC Act are to:<br />
< conserve biological diversity and promote ecologically sustainable development<br />
< prevent the extinction and promote the recovery <strong>of</strong> threatened species, populations and<br />
ecological communities<br />
< protect the critical habitat <strong>of</strong> those threatened species, populations and ecological<br />
communities that are endangered<br />
< eliminate or manage certain processes that threaten the survival or evolutionary<br />
development <strong>of</strong> threatened species, populations and ecological communities<br />
< ensure that the impact <strong>of</strong> any action affecting threatened species, populations and<br />
ecological communities is properly assessed<br />
< encourage the conservation <strong>of</strong> threatened species, populations and ecological<br />
communities by the adoption <strong>of</strong> measures involving cooperative management.<br />
Contained within the TSC Act are three schedules: Schedule 1 contains lists <strong>of</strong> critically<br />
endangered species and communities, endangered species, populations and communities, and<br />
extinct species; Schedule 2 contains lists <strong>of</strong> vulnerable species and communities; and Schedule 3<br />
contains a list <strong>of</strong> key threatening processes (KTPs).<br />
A KTP is eligible to be listed under the TSC Act if, in the opinion <strong>of</strong> the New South Wales<br />
Scientific Committee, it:<br />
< adversely affects two or more listed threatened species, populations or ecological<br />
communities<br />
or<br />
< could cause species, populations or ecological communities that are not threatened to<br />
become threatened.<br />
The Invasion <strong>of</strong> native plant communities by bitou bush and boneseed was listed as a KTP in<br />
March <strong>of</strong> 1999 (see <strong>NSW</strong> SC 1999a).<br />
Until the 2004 amendments to the TSC Act the preparation <strong>of</strong> a threat abatement plan (TAP) for<br />
each listed KTP was mandatory. However, this is no longer the case, with the requirement for<br />
preparation <strong>of</strong> a TAP being at the discretion <strong>of</strong> the Director General, DEC.<br />
Irrespective, a TAP must outline how the threatening process is to be managed so as to abate,<br />
ameliorate or eliminate its adverse effects on threatened species, populations or ecological<br />
communities. As a legal document under the TSC Act, a TAP requires ministers and public<br />
authorities to undertake the actions where appropriate, however a measure must not be included in<br />
a threat abatement plan for implementation by a public authority unless the authority’s CEO<br />
approves its inclusion. This plan meets the requirements <strong>of</strong> a TAP for the Invasion <strong>of</strong> native plant<br />
communities by bitou bush and boneseed as per the TSC Act.<br />
