<strong>Threat</strong> <strong>Abatement</strong> <strong>Plan</strong> - Invasion <strong>of</strong> native plant communities by Chrysanthemoides monilifera<br />

< use only pesticides registered by the Australian Pesticides and Veterinary Medicines<br />

Authority (APVMA) which are approved for the intended situation <strong>of</strong> use<br />

< read the pesticide registration label on pesticide containers (or have them read to them)<br />

and strictly follow the label directions<br />

< not risk injury to persons, property and non-target plants and animals through the use<br />

<strong>of</strong> a pesticide<br />

< obtain an APVMA permit if they wish to vary the label directions or use pattern<br />

< follow the instructions on any Pesticide Control Order relevant to the pesticide being<br />

used<br />

< make a record <strong>of</strong> all pesticide applications<br />

< become trained or licensed where required under the Pesticides Act and the Pesticides<br />

Regulation 1995, and<br />

< in some circumstances provide notice <strong>of</strong> their pesticide use.<br />

Pesticides Regulations<br />

The Pesticides Regulations establish the legislative requirements for the licensing <strong>of</strong> aerial<br />

pesticide applicator companies and the prescribed qualifications that pilots must hold before an<br />

aerial agricultural licence will be issued to them. The Regulations also outline the requirements<br />

for the control <strong>of</strong> prohibited residues and restricted pesticides.<br />

Additional amendments have been included under the Pesticides Regulation 1995 to include:<br />

Pesticide Record Keeping: Records must be kept by all people who use pesticides for<br />

commercial or occupational purposes such as on a farm, on produce, or as part <strong>of</strong> their<br />

occupation or business.<br />

Pesticide Training: People who use pesticides in their business or as part <strong>of</strong> their occupation<br />

must be trained in how to use those pesticides. Any person employed or engaged to use<br />

pesticides must also be trained.<br />

Pesticide Notification: From 1 February 2007, new notification requirements apply to<br />

pesticides applications by public authorities in outdoor public places and to pesticide<br />

applications by licensed pest management technicians in common areas <strong>of</strong> multioccupancy<br />

residential complexes.<br />

2.2.4 Protection <strong>of</strong> the Environment Operations Act<br />

Under the Protection <strong>of</strong> the Environment Operations Act 1997 (POEO Act), the DEC regulates<br />

general pollution and waste matters in New South Wales. This control also applies to pesticides.<br />

The selection and use <strong>of</strong> herbicides should be undertaken in accordance with relevant legislation<br />

and regulations to prevent the pollution <strong>of</strong> water.<br />

2.2.5 <strong>NSW</strong> National Parks and Wildlife Act<br />

The <strong>NSW</strong> National Parks and Wildlife Act 1974 (NPW Act) established the National Parks and<br />

Wildlife Service (NPWS), now part <strong>of</strong> DEC. The Parks and Wildlife Division <strong>of</strong> DEC is<br />

responsible for the care, control and management <strong>of</strong> all national parks, historic sites, nature<br />

reserves, Aboriginal areas, state conservation areas, karst conservation reserves, marine parks and<br />

regional parks within New South Wales in accordance with the NPW Act. DEC is also<br />

responsible under the Act for the protection <strong>of</strong> native fauna and flora and Aboriginal relics. DEC<br />

is responsible for the administration <strong>of</strong> the TSC Act and the Wilderness Act 1987.<br />
