Application for New License Middle Fork American River Project (FERC Project No. 2079) 7.0 EFFECTS OF THE NO-ACTION ALTERNATIVE The No-Action Alternative described in Section 4.1 maintains the existing baseline, with no benefits to existing resources (status quo). The MFP would continue to operate under the current license conditions and PCWA would continue to implement existing environmental and cultural measures for the protection and enhancement of resources in the vicinity of the MFP. Application for New License Middle Fork American River Project (FERC Project No. 2079) 8.0 CUMULATIVE EFFECTS USFWS is required to consider cumulative effects in formulating their biological opinions (50 CFR §402.14(g)(3) and (4)). Cumulative effects under ESA are defined as “…effects of future State, tribal, local or private actions that are reasonably certain to occur in the action area considered in the BA. Future federal actions that are unrelated to the proposed action are not considered because they require separate consultation pursuant to Section 7 of the Act.” The action under consideration is the issuance of a new license for the MFP, which includes modification and construction of MFP facilities, changes in routine operation and maintenance activities, and implementation of new environmental programs, measures, and facilities as described in Section 4.2 – Proposed Action. Implementation of the Proposed Action in conjunction with contributing effects of other future federal, state, tribal, local or private actions will not result in cumulative effects to federal listed species, candidates for listing, and FSS species or their habitats in the action area. As shown on BA/BE Map 17, other projects/actions considered in this cumulative effects analysis include: • Sacramento Municipal Utility District’s (SMUD) UARP (FERC Project No. 2101) that influences flow into Hell Hole Reservoir and along the South Fork Rubicon River, a tributary to the Rubicon River entering downstream of Hell Hole Reservoir • El Dorado Water and Power Authority’s (EDWPA) water rights application to store water in SMUD’s UARP reservoirs • Georgetown Divide Public Utility District’s (GDPUD) Stumpy Meadows Project (non-FERC project), which affects flows in Pilot Creek, a tributary to the Rubicon River entering downstream of Hell Hole Reservoir • Foresthill Public Utility District’s (FPUD) Sugar Pine Dam Project, which diverts water from Shirttail Creek (a tributary to the North Fork American River) to provide consumptive water to the community of Foresthill • PG&E’s Drum-Spaulding Project (FERC No. 2310) that influences flow into the North Fork American River from the Towle Diversion on Canyon Creek and the Lake Valley Diversion on the North Fork of the North Fork American River • Operations and maintenance of recreational facilities on Auburn State Project lands (referred to as the Auburn State Recreation Area [ASRA]) by USBR in the Middle Fork American River and North Fork American River downstream of Oxbow Powerhouse (peaking reach) • PCWA’s Pulp Mill Canal Diversion Dam Project that diverts water for consumptive use from Canyon Creek (a tributary to the North Fork American February 2011 8-1
