Application for New License Middle Fork American River Project (FERC Project No. 2079) • September 28, 2010: Draft License Application, including the Draft BA/BE, submitted to USFWS for a 90-day comment period. No comments received from USFWS. • January 11, 2011: USFWS states in a telephone message that the Draft BA/BE had been reviewed, and that it included all necessary information to evaluate potential project effects under ESA Section 7. The Draft BA/BE, which incorporates relicensing participant comments, is included in the Final License Application. This Draft BA/BE will be reviewed by FERC and used in conducting interagency consultation with USFWS. FERC will initiate this consultation by providing USFWS with a copy of the Draft BA/BE (as approved by FERC) and requesting formal consultation after submittal of the Final License Application by PCWA. FERC will also request that USFWS provide a biological opinion on their findings no later than 135 days from receipt of the request for formal consultation. February 2011 2-4
Application for New License Middle Fork American River Project (FERC Project No. 2079) 3.0 CURRENT REGULATORY MANAGEMENT This section summarizes current regulatory management as it pertains to the management of special-status species listed under the ESA, as well as species considered sensitive by USDA-FS. 3.1 ENDANGERED SPECIES ACT Pursuant to the federal ESA, the USFWS and National Oceanic and Atmospheric Administration – Fisheries Division (NOAA Fisheries) must be consulted with regard to Projects that may affect the continued existence of a federally listed species. Species are defined as threatened or endangered by USFWS if they are listed in 50 CFR §§17.11 or 17.12. ESA Section 9 and federal regulations prohibit the “take” of federally listed species; take is defined under ESA, in part, as killing, harming, or harassment of such species. Under federal regulations, take is further defined to include habitat modification or degradation where it actually results in death or injury to wildlife by significantly impairing essential behavioral patterns, including breeding, feeding, or sheltering. An incidental “take” permit under Section 10(a), or federal consultation under Section 7, is required if the Project might affect a federally listed species. For Projects where federal action is not involved and take of a listed species may occur, the Project proponent must secure an incidental take permit under Section 10(a) of the federal ESA. Because the MFP requires a federal action, this process does not apply and is not discussed further. Take of a federally listed species may be approved through Section 7 consultation between USFWS and another federal agency, if the proposed Project is sponsored by or under another federal agency’s jurisdiction. For this Project, Section 7 is applicable because PCWA is filing an application with the FERC to obtain new licenses for the MFP. As part of the process, PCWA is the nonfederal designee for Section 7 consultation and initiates informal consultation with USFWS on behalf of the FERC. Prior to completion of a BA, USFWS determines whether the proposed Project would have “no effect” on listed threatened or endangered species or “may affect” these species. Should USFWS render a “may affect” determination, formal consultation would be initiated between USFWS and the FERC via submittal of the BA to USFWS. A BA provides an evaluation of the effects of a Project on listed and proposed threatened and endangered species. USFWS then prepares a Biological Opinion regarding whether the Project would jeopardize the continued existence of a species.
