I. Proprietary Items - When a proprietary (brand name) product, whether material,<br />

equipment or procedure, are specified in the plans or specifications, they are used only<br />

to denote the style, type, character, and quality desired <strong>of</strong> the product. They do not<br />

restrict the bidder from proposing other brands, makes, or manufacturers, which are<br />

determined to be <strong>of</strong> equal quality. The approval, or disapproval <strong>of</strong> those products, will<br />

be made by the Project Manager prior to allowing those product(s) or material(s) to be<br />

incorporated into the work.<br />

J. Retainage by LGAs – The LGA for this contract will not retain any amount or percentage<br />

from progress payments or final estimates due the contractor.<br />

Retainage by Contractors – Contractors are NOT permitted to retain any amount or<br />

percentage from monies due their subcontractors or material suppliers on federally<br />

funded projects except as permitted by Subarticle 109-4(B) <strong>of</strong> the Standard Specifications.<br />

K. Traffic Control –The requirements <strong>of</strong> the Manual on Uniform Traffic Control Devices<br />

(MUTCD) – FHWA, as amended by the NCDOT Supplement to MUTCD, shall apply.<br />

Traffic Control, both vehicular and pedestrian, shall be maintained throughout the<br />

project as required by these specifications as modified by the project plans or special<br />

provisions.<br />

CHANGES TO THE NCDOT 2012 STANDARD SPECIFICATIONS (TOWN OF KERNERSVILLE)<br />

(10-19-12)<br />

1. Article 101-3 – References to Administrator, Board <strong>of</strong> Transportation, Department,<br />

NCDOT, and State, shall be modified as necessary to reference the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong><br />

and their Engineer.<br />

2. Article 102-1 – Project will be bid in accordance with G.S.143-129.<br />

3. Subarticle 102-8(B) Electronic Bids – Delete this Section<br />

4. Subarticle 102-12(A) –Paper Bids – In line 5 the reference to Contract Officer shall be<br />

changed to mean the person receiving the request for the municipality.<br />

5. Subarticle 102-12(B) Electronic Bids- Delete this Section<br />

6. Subarticle 103-2(B) Electronic Bids- Delete this Section<br />

7. Subarticle 103-3(A)-Criteria for Withdrawal <strong>of</strong> Bid-Modify the reference to G.S. 136-28.1<br />

to read G.S.143-129.1 In that same subarticle under (5), in the line 28, modify “State<br />

Contract Officer” to reference the Municipality or their Engineer.<br />

8. Article 103-7- In the first sentence, modify “14” calendar days to “10” per G.S. 143-129.<br />

9. Article 103-9- In the first sentence, modify “14” calendar days to “10”per G.S.143-129.<br />

10. Article 105-9 – Construction Stakeout will be performed by the Contractor in Accordance<br />

with Article 801.<br />

11. Article 107-5-This article will apply except it shall be the responsibility <strong>of</strong> the municipality<br />

to obtain permission and not the contractor.<br />

12. Article 108-3 The “Division Engineer” in line 18, shall be modified to reference the <strong>Town</strong> <strong>of</strong><br />

<strong>Kernersville</strong> and their Engineer.<br />

13. Article 108-4- The “Resident Engineer” in line 26 shall be modified to reference the <strong>Town</strong><br />

<strong>of</strong> <strong>Kernersville</strong> and their Engineer.<br />

14. Article -620-4 Delete paragraphs 5 through 10-Asphalt Price Adjustments (APA) are NOT<br />

to be part <strong>of</strong> this contract.<br />
