National<br />
• <strong>The</strong> Wild Animal Reservation <strong>and</strong> Protection Act of 1992 should be comprehensively amended to<br />
<strong>in</strong>clude specific legislative provisions relat<strong>in</strong>g to the control of <strong>in</strong>ternal <strong>and</strong> <strong>in</strong>ternational <strong>trade</strong> <strong>in</strong> live<br />
<strong>elephant</strong>s <strong>and</strong> other <strong>elephant</strong> products, particularly <strong>ivory</strong>. Loopholes <strong>in</strong> exist<strong>in</strong>g Thai law, such as<br />
allow<strong>in</strong>g the legal commercialization of <strong>ivory</strong> obta<strong>in</strong>ed from domesticated <strong>elephant</strong>s, should be closed <strong>and</strong><br />
the CITES requirements for <strong>in</strong>ternal <strong>trade</strong> <strong>in</strong> <strong>ivory</strong> articulated <strong>in</strong> Resolution Conf. 10.10 (Rev. CoP14)<br />
should be codified.<br />
• <strong>The</strong> draft<strong>in</strong>g of any legislation that aims to rationalize under one new law all provisions relat<strong>in</strong>g to<br />
<strong>elephant</strong>s <strong>and</strong> <strong>ivory</strong> <strong>in</strong> exist<strong>in</strong>g legislation should be coord<strong>in</strong>ated with the WARPA revision <strong>in</strong> order to<br />
avoid any contradictions or conflicts, particularly <strong>in</strong> the area of <strong>in</strong>ternal <strong>and</strong> <strong>in</strong>ternational movements <strong>and</strong><br />
<strong>trade</strong>.<br />
• <strong>The</strong> new law should also <strong>in</strong>clude provisions requir<strong>in</strong>g domesticated <strong>elephant</strong>s to be registered at<br />
birth, possibly us<strong>in</strong>g microchips, <strong>and</strong> that a computerized national database of registered <strong>elephant</strong>s us<strong>in</strong>g<br />
DNA identification be established <strong>in</strong> order that the movements of live <strong>elephant</strong>s <strong>and</strong> <strong>ivory</strong> can be tracked<br />
<strong>in</strong> the future.<br />
• Thai Customs Department officials should be tra<strong>in</strong>ed <strong>in</strong> the identification of <strong>ivory</strong>, <strong>and</strong><br />
comprehensive methods for scrut<strong>in</strong>iz<strong>in</strong>g CITES permits for accuracy <strong>and</strong> compliance <strong>in</strong> order to reduce the<br />
likelihood of fraudulent documents be<strong>in</strong>g used to legalise illicit wildlife exports <strong>and</strong> imports. Customs<br />
officials should ensure that imported items at airports <strong>and</strong> ports correspond correctly with import<br />
declarations <strong>in</strong> the expectation that illegal raw <strong>ivory</strong> shipments from Africa will be attempted <strong>in</strong> the future.<br />
• Thai authorities knowledgeable about <strong>ivory</strong> <strong>trade</strong> issues <strong>and</strong> competent <strong>in</strong> <strong>ivory</strong> identification<br />
should visit known workshops <strong>and</strong> retail outlets deal<strong>in</strong>g with <strong>ivory</strong> <strong>and</strong> confiscate any specimens whose<br />
age <strong>and</strong> provenance cannot be proven to be <strong>in</strong> compliance with CITES <strong>and</strong> national regulations.<br />
• <strong>The</strong> Thai Government should ensure that Thail<strong>and</strong>’s multi-agency National Task Force under<br />
ASEAN-WEN is able to carry out a programme of cont<strong>in</strong>uous monitor<strong>in</strong>g of <strong>elephant</strong> <strong>and</strong> <strong>elephant</strong><br />
product <strong>trade</strong> as one of its ongo<strong>in</strong>g priorities.<br />
• It would be useful for the Thai Government to sponsor a study on the usage of <strong>elephant</strong>s <strong>in</strong> the<br />
tourist <strong>in</strong>dustry, as the extent of current practices has not been assessed as to whether it encourages the<br />
capture of wild <strong>elephant</strong>s from Thail<strong>and</strong> or neighbour<strong>in</strong>g countries. In general, the tourist <strong>in</strong>dustry’s<br />
impacts on wild <strong>elephant</strong> populations <strong>in</strong> Thail<strong>and</strong> is poorly understood.<br />
<strong>The</strong> <strong>elephant</strong> <strong>and</strong> <strong>ivory</strong> <strong>trade</strong> <strong>in</strong> Thail<strong>and</strong><br />
