Domesticated Thai <strong>elephant</strong>s, however, come under the Draught Animal Act of 1939 (along with cows,<br />

water buffalo <strong>and</strong> other livestock); this Act does not ban the <strong>trade</strong> of domesticated <strong>elephant</strong>s nor the<br />

possession or sale of <strong>ivory</strong> from Thai domesticated <strong>elephant</strong>s (Lair, 1997). Accord<strong>in</strong>g to a former Director<br />

of the CITES Division <strong>in</strong> the Royal Forest Department, if an official tries to arrest an <strong>ivory</strong> <strong>trade</strong>r or<br />

shopkeeper he will state that his <strong>ivory</strong> came from domesticated Thai <strong>elephant</strong>s. S<strong>in</strong>ce government officers<br />

are generally unable to dist<strong>in</strong>guish the <strong>ivory</strong> types, the government cannot successfully prosecute. <strong>The</strong><br />

majority of legal raw <strong>ivory</strong> <strong>in</strong> Thail<strong>and</strong> comes from domesticated <strong>elephant</strong>s that have had their tusks pruned<br />

(former Director of the CITES Division quoted <strong>in</strong> the Bangkok Post, Anon., 2001).<br />

<strong>The</strong> Draught Animal Act of 1939 also requires that <strong>elephant</strong> owners register them at eight years of age with<br />

the District Office of the Local Adm<strong>in</strong>istration Department <strong>and</strong> obta<strong>in</strong> an <strong>elephant</strong> identification card. If<br />

the <strong>elephant</strong> is moved to another district the owner should report to the new district authorities with<strong>in</strong> 30<br />

days. Elephants found without proper identification can be confiscated <strong>and</strong> it is up to the owner to prove<br />

ownership (Pimmanrojnagool <strong>and</strong> Wanghongsa, 2002).<br />

<strong>The</strong> Animal Epidemics Act of<br />

1956 requires an <strong>elephant</strong><br />

owner to obta<strong>in</strong> official<br />

permission <strong>in</strong> writ<strong>in</strong>g before<br />

mov<strong>in</strong>g an <strong>elephant</strong> out of a<br />

prov<strong>in</strong>ce or trad<strong>in</strong>g a live<br />

<strong>elephant</strong> or its carcass.<br />

<strong>The</strong> Customs Act of 1926, the<br />

Commercial Registration Act<br />

of 1956, <strong>and</strong> the Export <strong>and</strong><br />

Import of Goods Act of 1979<br />

are also all applied to CITES<br />

implementation. For example,<br />

the M<strong>in</strong>istry of Commerce<br />

ordered <strong>in</strong> 2007 that all<br />

wildlife entrepreneurs be<br />

registered, a process that is<br />

be<strong>in</strong>g carried out by the<br />

Market Control Authority<br />
