An unbeliever who insults one of the prophets is to<br />
be killed; if he insults or curses God <strong>and</strong> repents, the<br />
punishment must be remitted, for, in the case of transgression<br />
of man, the punishment is necessary but in a<br />
transgression against God, the punishment can be remitted,<br />
for 'God is forgiving <strong>and</strong> merciful'.<br />
Sbahid, Martyr.<br />
In Muhammadan law the word SbahId is a very comprehensive<br />
term; it is used not only for those who die in<br />
witness of, or in defence of <strong>Islam</strong> but for all those also<br />
who die such deaths as are calc';lated to excire the compassion<br />
<strong>and</strong> pity of their fellow men.<br />
A perfect martyr (Shahid-i-kamil) is one who has'<br />
either been slain in a religious war, or who has been<br />
killed unjustly. A special blessing is promised to those<br />
who die in a Jihad. "Count not those who are killed in<br />
the way of God as dead, but living with their Lord ;-provided<br />
for, rejoicing in what God has brought them of His<br />
grace, <strong>and</strong> being glad for those who ltave not reached<br />
them yet,--those left behind them; there is no fear for<br />
them, <strong>and</strong> they shall not be grieved; glad at the favour<br />
from God <strong>and</strong> grace, <strong>and</strong> that God wasteth not the hire of<br />
the believers. (Sura 3: 163-165).<br />
According to Muslim law, all persons who die in the<br />
defence of the faith, or have been slain unjustly, are<br />
entitled to Muslim burial without the usual ablution or<br />
any change of clothes, such as are necessary in the case of<br />
ordinary persons, the rank of martyrdom being such as<br />
render the corpse legally pure.<br />
Daru'l-Harb And Daru'I-<strong>Islam</strong>.<br />
The world, on the basis of the doctrine of Jihad, is<br />
divided into two great divisions, viz. (1) Daru'I-l:larb<br />
(2) Datu'I-<strong>Islam</strong>. Daru'I-l:larb is a country belonging<br />

to infidels which has not been subdued by <strong>Islam</strong>, while<br />
Daru'l-<strong>Islam</strong> is a country in which the edicts of <strong>Islam</strong> are<br />
fully promulgated.<br />
'<br />
In a state brought under Muslims, all those who do<br />
not embrace <strong>Islam</strong> are placed under certain disabilities.<br />
They can worship God according to their own customs,<br />
provided they are not idolaters: but it must be done without<br />
any ostentation, <strong>and</strong>, whilst churches <strong>and</strong> synagogues<br />
may be repaired, no new place of worship can be erected.<br />
Datu'I-<strong>Islam</strong> again becomes Daru'I-Harb on the following<br />
conditions: .<br />
(1) That the edicts of unbelievers be promulgated, <strong>and</strong><br />
the edicts of <strong>Islam</strong> be suppressed.<br />
(2) That the country in question be adjoining a Daru'll:larb<br />
<strong>and</strong> other Muslim country lie between them<br />
(that is, when the duty of Jihad becomes incumbent<br />
on them, they have no power to carry it on).<br />
(3) That no protection (aman) remains for either a<br />
Muslim or a DhimmI: viz., that amanu'l-awwal, or<br />
that first protection which was given them when<br />
the country was first conquered by <strong>Islam</strong>.<br />
A Datu1-l:larb becomes a Daru'I-<strong>Islam</strong> when the<br />
laws of <strong>Islam</strong> are promulgated in it, <strong>and</strong> it is governed in<br />
accordance with the same, so that the Friday prayers <strong>and</strong><br />
Muslim festivals are observed.
