A Sovereign Is Not Punishable.<br />

If a supreme ruler (such as the Kbalifa) commit any<br />

offence punishable by law, such as adultery, fornication,<br />

theft, or drunkenness, he is not subject to any punishment<br />

. (but yet if he commit murder he is subject to the retaliation,<br />

<strong>and</strong> he is also accountable in matters of property),<br />

because punishment is a right of God, the infliction of<br />

which is committed to the Kballfa (or other supreme<br />

magistrate), <strong>and</strong> to none else; <strong>and</strong> he cannot inflict punishment<br />

upon himself.<br />

CHAPTER VII.<br />

Miscellaneous Subjects.<br />

Slaying of Animals (Dhabah).<br />

All animals, the flesh of which is eatable, except fish<br />

<strong>and</strong> locusts, when killed for food must be slain by dhabal}.<br />

The object of dllabal} is to separate the blood from the<br />

flesh. The place for slaying is between the throat <strong>and</strong> the<br />

head of the breast-bone, because the blood freely issues<br />

from a wound given in that place.<br />

Dhabah is of two kinds:<br />

(1) D\abaJ.lU'I-IkhtiYiirI, of choice, or voluntary<br />

which is performed by cutting the throat above<br />

the breast.<br />

(2) Dt,aba].lu'l-Iq.tiriirl, or of necessity, that is, at<br />

r<strong>and</strong>om, from necessity, which is effected by a<br />

wound or any part of the animal's body..<br />

It is a condition of Dhaba].lu'I-IkhtiYiirI that the<br />

name of God be pronounced over the animal at the<br />

time of slaying it. In the case of Dt,aba].lu'I-Iq.tiriirI (or of<br />

a man slaying an animal in hunting), the condition is that<br />

invocation be pronounced at the time of letting loose the<br />

hound or hawk, or shooting the arrow, which is called an<br />

invocation over the instrument.<br />

The Dhaba].l must be performed by a Muslim, or<br />

Kitiibl (a Jew or a Christian) provided he be a person<br />

acquainted with the form of invocation, whether man or<br />

woman, infant or idiot. It cannot be performed by an<br />

idolater or an apostate.<br />

All animals not eatable, such as rats, dogs or cats,<br />

when their flesh is required to be used in medical composition,<br />

are rendered clean by Dhaba].l.
