change in <strong>the</strong> law that is contrary to both <strong>the</strong> letter and intent of both <strong>the</strong> federal Surface Mining Act and<br />
Clean Water Act.<br />
• October 2007: At The Echo Project, a new environmentally-<strong>the</strong>med music festival outside of Atlanta,<br />
Georgia, <strong>Rock</strong> <strong>the</strong> Ea<strong>rt</strong>h hosted daily environmental panels and interviews on a solar stage in <strong>the</strong> Echo-System<br />
tent, featuring Adrian Zelski (Dubconscious), Futu<strong>re</strong>man (Bela Fleck & The Flecktones, Black Motza<strong>rt</strong><br />
Orchestra), Matt McDonald (Perpetual Groove), John Medeski (Medeski, Ma<strong>rt</strong>in & Wood),<br />
B<strong>re</strong>ndan Bayliss (Umph<strong>re</strong>y’s McGee), JJ G<strong>re</strong>y (MOFRO), Neal Turley (Sustainable Waves), Paul<br />
Diaz (T<strong>re</strong>e Sound Studios), Andy Bernstein (Headcount), and moderated by RtE Executive Di<strong>re</strong>ctor Marc<br />
Ross. The weekend was highlighted by a panel discussion of environmental professionals working to protect<br />
<strong>the</strong> Chattahoochee River, featuring Sally Ba<strong>the</strong>a (Upper Chattahoochee Riverkeeper), Allison Hughes<br />
(Rivers Alive) and Jeff Margolin (Environ), and sponso<strong>re</strong>d by Sweetwater B<strong>re</strong>wing Company.<br />
• October 2007: Attorneys for <strong>Rock</strong> <strong>the</strong> Ea<strong>rt</strong>h and its plaintiff pa<strong>rt</strong>ners went befo<strong>re</strong> United States District<br />
Cou<strong>rt</strong> Judge David G. Campbell in Phoenix, Arizona, for oral argument in <strong>the</strong> lawsuit over <strong>the</strong> Colorado<br />
River Management Plan.<br />
• October 2007: <strong>Rock</strong> <strong>the</strong> Ea<strong>rt</strong>h deepened its pa<strong>rt</strong>nership with Gulf Restoration Network, unde<strong>rt</strong>aking a<br />
public text messaging campaign to members of Cong<strong>re</strong>ss to petition <strong>the</strong> federal government to<br />
suppo<strong>rt</strong> inc<strong>re</strong>ased effo<strong>rt</strong>s to <strong>re</strong>sto<strong>re</strong> critical wetlands and o<strong>the</strong>r environmental controls and <strong>re</strong>mediation in<br />
<strong>the</strong> Katrina-ravaged Gulf Region.<br />
• December 2007: <strong>Rock</strong> <strong>the</strong> Ea<strong>rt</strong>h volunteers and staff collaborated with John Butler Trio, B<strong>re</strong>tt Dennen,<br />
CLIF Bar G<strong>re</strong>en Notes, Surfrider Foundation, and Save <strong>the</strong> Bay, on a beach cleanup and<br />
conce<strong>rt</strong> at Ocean Beach in San Francisco, California.<br />
• December 2007: Judge David G. Campbell of <strong>the</strong> U.S. District Cou<strong>rt</strong> of Arizona ruled against <strong>Rock</strong> <strong>the</strong><br />
Ea<strong>rt</strong>h and its plaintiff pa<strong>rt</strong>ners on <strong>the</strong>ir challenge to <strong>the</strong> Colorado River Management Plan. <strong>Rock</strong> <strong>the</strong> Ea<strong>rt</strong>h<br />
intends to appeal <strong>the</strong> District Cou<strong>rt</strong> decision to <strong>the</strong> 9 th Circuit Cou<strong>rt</strong> of Appeals in early 2008.<br />
In addition to <strong>the</strong> formal legal and educational activities that RtE conducted in 2007, our legal and technical<br />
staff members <strong>re</strong>viewed or monito<strong>re</strong>d <strong>the</strong> following issues:<br />
• <strong>Rock</strong> <strong>the</strong> Ea<strong>rt</strong>h and <strong>the</strong> Hawaiian Conservation Alliance (KAHEA) continued <strong>re</strong>view of “<strong>re</strong>search” permits<br />
issued by state and federal authorities in <strong>the</strong> newly established Papahnaumokuakea Marine National<br />
Monument. Many of <strong>the</strong>se permits allow for activities specifically banned by state and federal law. This<br />
work was pa<strong>rt</strong>ially funded by Jack Johnson.<br />
• Non-compliant discharges from publicly owned sewage facilities along <strong>the</strong> Chattahoochee River in <strong>the</strong> Atlanta<br />
metropolitan a<strong>re</strong>a, an issue suggested to us by fans of Jack Johnson during our 2005 Summer Tour;<br />
• The declining water levels in <strong>the</strong> G<strong>re</strong>at Lakes, an issue suggested to us by Steven Page of <strong>the</strong> Ba<strong>re</strong>naked<br />
Ladies;<br />
• The construction of <strong>the</strong> Sevier Power Company’s coal-fi<strong>re</strong>d electric generation facility in sou<strong>the</strong>rn Utah, an<br />
issue suggested to us by <strong>the</strong> San Francisco band, ALO (Animal Liberation Orchestra);<br />
• Identification of large emitters of pollution in <strong>the</strong> San Joaquin Valley in California, an issue also<br />
suggested to us by ALO;<br />
• The disposal of nuclear waste on Native American lands, an issue suggested to us by Peter<br />
Rowan;<br />
• Various issues concerning development in <strong>the</strong> headwaters of, and wetlands tied to <strong>the</strong> St.<br />
Johns River in no<strong>rt</strong>hern Florida, as well as large water diversions from <strong>the</strong> river, issues suggested<br />
by Debbie Trucks, mo<strong>the</strong>r to De<strong>re</strong>k Trucks and mo<strong>the</strong>r-in-law to Susan Tedeschi;<br />
• Proposed statutory and <strong>re</strong>gulatory changes to <strong>the</strong> National Environmental Policy Act.<br />
As we look to 2008, it becomes clear that we a<strong>re</strong> moving closer to our vision for <strong>Rock</strong> <strong>the</strong> Ea<strong>rt</strong>h to<br />
become <strong>the</strong> p<strong>re</strong>-eminent environmental advocacy organization to work with <strong>the</strong> music<br />
community. As we continue to prosecute our first case against <strong>the</strong> National Park Service over <strong>the</strong><br />
Colorado River Management Plan, we a<strong>re</strong> al<strong>re</strong>ady looking towards potential litigation to challenge<br />
eco-prospectors in <strong>the</strong> NW Hawaiian Islands, snowmobiles in Yellowstone & Teton National Parks,<br />
communities applying pesticides to waterways without permits <strong>re</strong>qui<strong>re</strong>d by <strong>the</strong> Clean Water Act,<br />
and inadequate studies for <strong>the</strong> expansion of <strong>the</strong> Pinon Canyon Maneuver Site.<br />
In addition, we will continue to investigate several of <strong>the</strong> issues listed above as well as continue to<br />
solicit new issues from <strong>the</strong> music community. As we begin campaigns on various issues, we will<br />
seek to elevate <strong>the</strong>ir impo<strong>rt</strong>ance to <strong>the</strong> public by <strong>re</strong>aching out to members of <strong>the</strong> music industry to<br />
assist us in publicity and fundraising effo<strong>rt</strong>s.
