properly move, remove or care for the facilities in conflict with the Employer's water<br />

pipes.<br />

When electric cables, telephone cables, sewers drains, other pipelines, subsurface<br />

structures and/or utilities parallel and are in close proximity to the Work and they<br />

must be removed, relocated or altered in any way, the Work shall be in strict<br />

accordance with the requirements and specifications of the owner of said facilities.<br />

In addition, the Contractor shall pay particular attention to poles, pole lines, overhead<br />

wires and all other facilities aboveground that may be in conflict with the work. The<br />

Contractor shall follow the same procedures outlined herein for underground<br />

facilities.<br />

No claim for additional compensation will be allowed on account of any delay<br />

occasioned by the relocation of the Employer's water pipes or the relocation or<br />

removal of the pipe lines, subsurface structures and/or utilities above and below<br />

ground necessary for the construction of the Employer's water pipes. The entire cost<br />

of all pipelines, subsurface structures and/or utilities or other subsurface or<br />

aboveground facilities shall be included in the prices stipulated for the appropriate<br />

items of the Contract.<br />

1.14 Safety of Adjoining Existing Buildings<br />

The Contractor shall take all necessary precautions during the excavation for the<br />

Works particularity those excavations which are adjoining existing building and shall<br />

protect such buildings from damage or collapse by means of temporary or permanent<br />

shoring, strutting, sheet piling or underpinning or excavation in short length and/or<br />

other methods as he deems fit. Also, he shall properly support all foundations,<br />

trenches, walls, floors, etc..., affecting the safety of the adjoining existing buildings.<br />

The contractor has to reconstruct any construction which will be affected by him<br />

during his works without any additional cost and this will be his own responsibility.<br />

The Contractor shall alter, adopt and maintain all such Works described above for the<br />

whole period of the Contract and shall finally clear away and make good all damages<br />

done.<br />

The construction and efficiency of the shoring, underpinning, strutting, etc..., for the<br />

purpose for which it is erected shall be the responsibility of the Contractor. Should<br />

any subsidence or any other damage occur due to the inefficiency of the shoring,<br />

underpinning, strutting, etc..., or any other support provided, the damage shall be<br />

made good by the Contractor at his own expense and responsibility.<br />

The shoring strutting, piling, etc..., shall be executed in such a manner as to cause as<br />

little inconvenience as possible to adjoining owners or the public and the Contractor<br />

shall be responsible for negotiating with the adjoining owners the means to safeguard<br />

their property and for the use of any portion of their land for the purpose of executing<br />

the excavations and no claims submitted on this ground will be entertained.<br />
