American Samoa Code, Title 46 Chapter 37 provides<br />
offences for prostitution (46.3702), patronizing<br />
prostitution (46.3703), promoting prostitution<br />
(46.3705). Brothels are illegal and considered ‘public<br />
nuisances’. (46.3703)<br />
Crimes Act 1969 provides offences for: brothel<br />
keeping (defined to include any place used for the<br />
purposes of prostitution, whether by one woman<br />
or more) (Section 160); living on earnings of<br />
prostitution (Section 161); procuring (Section 162);<br />
and soliciting (i.e. being a common prostitute who<br />
loiters and importunes persons in any public place<br />
for the purpose of prostitution (Section 163).<br />
Assumed to apply laws based on those of the<br />
French Republic, under which sex work is legal.<br />
Soliciting, owning or operating a brothel and<br />
procuring are illegal.<br />
Niue Act 1966 provides that it is an offence to ‘loiter<br />
and importune’ any person in any public place for<br />
the purpose of prostitution (s.220) and to keep a<br />
brothel (s.175).<br />
The Sexual Offences Act (UK) provides offences<br />
for soliciting (Section 51A); causing or inciting<br />
prostitution for gain (Section 52); Controlling<br />
prostitution for gain (Section 53); and keeping a<br />
brothel used for prostitution (section 33A).<br />
Crimes Ordinance 1961 provides offences for brothel<br />
keeping, (brothel defined as any place used for the<br />
purposes of prostitution, whether by one woman<br />
or more) (Section 58K); living on earnings of<br />
prostitution (Section 58L); and procuring (Section<br />
58M).<br />
Rule 25 of the Crimes, Procedure and Evidence Rules<br />
2003 provide that any person who loiters and<br />
importunes any person in any public place for the<br />
purpose of prostitution commits an offence.<br />
