5 (3) The Bank releases the budgetary financial means for the community in accordance with the contract regarding to the Section 1. (4) Special regulations are related to the management and usage of the above mentioned financial support provided for a community to establish the industrial park. § 8 Assignment, lease and interchange of lands (1) The Fund, after the decision of the Ministry on financial support is delivered(§ 6 Section 9 Letter b) will conclude the written contract with the community on assignment or lease of lands and based on it the Fund will assign the lands managing by it5) into the ownership of the community or it will lease them to establish the industrial park. If any interchange of lands managing by the Fund with lands in ownership of the community is possible, this interchange will be performed preferably. To interchange the lands a written interchange contract16) between the Fund and the community shall be concluded. The conditions to terminate the contracts in accordance with § 11 shall be included in the above mentioned contracts. (2) Assignment of the land in accordance with the Section 1 shall be performed by the Fund for the minimum price determined by the Price Regulation12). (3) The land lease contract (Section 1) shall be concluded between the Fund and the community for a determined period however for minimum 50 years. If nothing else is agreed between the above mentioned contractual parties, the right of the community to construct technical facilities of the area and civil engineering works necessary to establish the industrial park (§ 3 Sections 2 and 3) and right to establish the right of using16) connected with the relevant land or building in the industrial park as well as the right of the community to rent the land in the industrial park for entrepreneurs to perform some constructions shall be included in the contract17). (4) The contract mentioned in the Sections 1 and 3 shall be concluded within 30 days from the delivery of the community proposal to conclude the contract if nothing else is agreed by the contractual parties. § 9 Control of the support usage To control the usage of granted support and application of responsibility for contravention of the budgetary discipline special regulations are to be applied18). § 10 Termination of financial support providing and return of granted budgetary financial support (1) The Ministry shall avoid the contract on providing the budgetary financial support (§ 7 Section 1) when the relevant community fails to fulfil the conditions to provide the financial budgetary support or when the community fails to commence the implementation of the technical facilities and civil engineering works necessary to establish the industrial park within two years. In this case the community is obliged to return the financial budgetary support within 30 days from the date of information delivery on termination of the contract to the Ministry which was provided to establish the industrial park. (2) The Ministry will not be responsible for any damages against the community or entrepreneurs in the industrial park arisen as a consequence of the contract termination in accordance with the Section 1. § 11 Return of lands and termination of the lease or interchange contract (1) The Fund terminates the contract on land assignment or lease for a community, or interchange contract (§ 6 Section 1) if the relevant community fails to fulfil the conditions mentioned in the contract on land assignment or lease for a community, or interchange contract and does not commence the construction of the technical facilities and civil engineering works unavoidable to establish the industrial park within 2 years after the date of contract concluding. In this case the community is obliged to return the hired, assigned or interchanged land back to the Fund within 3 months from the date of notification delivery on the contract termination if nothing else is agreed by the contractual parties. Before returning the land back to the Fund the community is obliged to bring the land into its original state on its own costs. When failing to do it by the community the Fund is entitled to bring the land into its original state on the costs of the relevant community. (2) When the land returned back to the Fund by the community in accordance with the Section 1 were extracted from the Agricultural Soil Fund19), the Fund is obliged to require at the relevant body of the Agricultural Soil Fund Protection20) to approve the change of the non-agricultural soil category into the agricultural soil category in accordance with the separate regulation21). (3) The community is obliged, after returning the lands back to the Fund, to pay a penalty for unauthorized usage of the lands in amount of one tenth of the land price regarding to the Price Regulation for every, also commenced months after elapsing the period for land returning in accordance with the Section 1. The Fund will be not responsible for damages arisen for the community or entrepreneurs in the industrial park as a consequence of contract termination (Section 1). § 12 Relation to the Administrative Order The General regulation on administrative proceedings in not related to act in accordance with this Code. § 13 Temporary provision The community which commenced the establishment of the industrial park before this Code became valid and effective may be provided with the financial support in accordance with § 2, when it fulfils the conditions to get the support in accordance with § 4 and the technical facilities and civil engineering works necessary to establish the industrial park were not finished and the settlements and payments in accordance with § 3 were not performed yet. Article II The Code No. 180/1995 Coll. issued by National Assembly of Slovak Republic on some measures to readjust the relationship to lands in wording of the Constitution Court Finding No. 131/1996 Coll., Code No. 80/1998 Col.., and Code No. 219/2000 Coll. shall be amended as follows: In § 19 Section 2, the full-stop on the sentence end is cancelled and the following words shall be amended: “and for the purposes of establishment of the industrial park”. Article III This Code is valid and effective by the date of June 1, 2001. 6 R E G I O N S O F S L O V A K I A BRATISLAVA Region General Information Bratislava region is the smallest of all the Slovakia’s regions but it is far from being the least important. It is made up by Podunajská nížina and Záhorská nížina lowlands separated by the Little Carpathian Mountains. The important geographical feature is the river Danube, which bounds the region from the south and the river Morava which bounds it from the west. While many regions claim a strategic location, Bratislava is a genuine central European crossroad with borders on the Czech Republic, Austria and Hungary. From other regions the only one having common border with Bratislava is Trnava region. Important ethnic minorities are Hungarians 5,2% and Czechs 2%. The regional center Bratislava, capital of The Slovak Republic, is also the seat of national government and various organizations of nation-wide importance. Services, other branches28% Agriculture 1% Industry in total 21% ECONOMY As a result of its location, the region Bratislava has managed to develop into the economically most important region of the Slovakia. The industry of the region comprises all the sectors. Noteworthy fact concerning its distribution within region is its high concentration degree. In Bratislava almost 70% of all the employees in industry finds their job. The south of the region specializes in the industries with complementary character to agriculture. The Bratislava region has the biggest share on the gross domestic product (23,6%). STRUCTURE OF THE INDUSTRY Main sectors of the industry in the region are Chemistry, Automotive, Engineering, Electrotechnic and Food processing. These sectors can use strong advantages of the region – high educational level, developed transport and technical infrastructure, active foreign trade, highest home demand for goods and services. Despite of this fact, Bratislava is the first Slovak region, where the industry sector plays much less important role as the trade and services. There are the biggest foreign investors in Slovakia. This is especially true in the field of trade and services, where most of the investors are in Bratislava.
