In accordance with section 8A(3)) of the Planning and Environment Act 1987, the Minister for Planning authorised the Wyndham City Council as planning authority to prepare the Amendment. The land affected by the Amendment is comprised of 14 allotments within Tarneit West bounded by Davis Creek to the west, Hogans Road to the south, Tarneit Road to the east, and the southern boundary of Claremont Park Estate. The Amendment proposes to rezone 12 lots from Farming Zone 1 to Residential 1 Zone, and two lots from Farming Zone 1 to Public Park and Recreation Zone. This Amendment is being undertaken in conjunction with Amendment C106 which is proposing to place a Development Plan Overlay and Developer Contributions Overlays on the land. In accordance with section 9(2) of the Planning and Environment Act 1987, the Minister for Planning authorised the Wyndham Council as planning authority to prepare the Amendment. The Amendment applies to an area of 118 ha bounded by Davis Creek, Hogans and Tarneit Roads and the southern boundary of Claremont Park Estate. The Amendment intends to implement the Tarneit West Outline Development Plan (ODP) and Tarneit West Development Contributions Plan (DCP) by introducing the following overlays into the planning scheme: 1. A Development Plan Overlay – Schedule 10 (DPO10) to incorporate the Tarneit West Outline Development Plan; and

Tarneit West Development Contributions Plan, that is enabled by the following two components: a) A Development Contributions Overlay – Schedule 6 (DCPO6) would apply a general DCP to the whole of the Tarneit West area for contributions towards the arterial roads and major paths network, community and other infrastructure; b) A Development Contributions Overlay – Schedule 7 (DCPO7) would apply a specific contributions plan for Wootten Road, so that the costs associated with the upgrade of this road can be fairly distributed across landowners with direct abuttal to Wootten Road.
