‘North Melbourne public housing estate’ means all properties in the area bounded by Alfred<br />
Street, Melrose Street, Canning Street and Boundary Road, North Melbourne, under the<br />
control of the <strong>Victoria</strong>n Department of Human Services.<br />
‘Racecourse Road retail centre’ means the retail centre generally in the vicinity of the<br />
Newmarket railway station.<br />
2. Commencement<br />
This Order comes into operation on 1 July 2008.<br />
3. Boundaries<br />
3.1 On the appointed day, the municipal boundary of the Melbourne City Council shall be<br />
altered and fixed as described in Schedule 1;<br />
3.2 On the appointed day, the municipal boundary of the Moonee Valley City Council<br />
shall be altered and fixed as described in Schedule 2.<br />
4. General – Transitional Provisions<br />
4.1 The Moonee Valley City Council and Melbourne City Council must come to an<br />
agreement on the apportionment, settlement, transfer, adjustment or determination of<br />
any property, income, assets, liabilities, expenses, staff or other matters in relation to<br />
the annexed area within ninety days of the appointed day.<br />
5. Rating – Transitional provisions<br />
5.1 Despite anything to the contrary in the Act, a person is liable to pay the Melbourne<br />
City Council any rates and charges declared by the Moonee Valley City Council under<br />
section 158 of the Act prior to the appointed day in respect of land in the annexed area<br />
as if the land in the annexed area were still part of the municipal district of the Moonee<br />
Valley City Council.<br />
5.2 The Melbourne City Council must pay the Moonee Valley City Council all amounts<br />
under clause 5.1 received by it on and after the appointed day.<br />
5.3 Any special rate or charge declared by the Moonee Valley City Council under section<br />
163 of the Act concerning the Racecourse Road retail centre in force immediately<br />
prior to the appointed day and levied on any person liable to pay the special rate<br />
or charge with respect to a rateable property in the annexed area shall continue to<br />
apply to those persons and be levied by Moonee Valley City Council for the period it<br />
continues to remain in force.<br />
5.4 General rates declared by the Melbourne City Council in respect of any non-residential<br />
land in the annexed area shall be declared as follows:<br />

2008/09 No greater than 110 per cent of the general rates for that land<br />
declared by the Moonee Valley City Council for the 2007/08<br />
financial year.<br />
2009/10 No greater than 120 per cent of the general rates for that land<br />
declared by the Moonee Valley City Council for the 2007/08<br />
financial year.<br />
2010/11 No greater than 130 per cent of the general rates for that land<br />
declared by the Moonee Valley City Council for the 2007/08<br />
financial year.
