3092 G 50 13 December 2007 Victoria Government Gazette Chapter 9 Chapter 9 is amended by inserting the following clause after clause 9.1B: “9.1C MARKET RISK REVIEW (a) VENCorp must complete a review of market risk by March 2008, including but not limited to a review of the methodology and triggers for VoLL, administered price periods and the administered price cap, and any other factors that VENCorp considers to be appropriate. (b) VENCorp must consult with affected parties when undertaking the review contemplated in clause 9.1C(a).” Chapter 11 11 Glossary is amended by inserting after the definition “administered price period” a new definition as follows: administered pricing procedure A procedure established in accordance with clause 3.2.5(a) or amended in accordance with clause 3.2.5(b) that defines requirements for declaring and ending administered price periods. Dated 11 December 2007 Responsible Minister PETER BATCHELOR MP Minister for Energy and Resources MELISSA van ROSSUM Acting Clerk of the Executive Council Local Government Act 1989 ALTERATION TO BOUNDARIES OF THE MUNICIPAL DISTRICTS OF THE MELBOURNE CITY COUNCIL AND THE MOONEE VALLEY CITY COUNCIL Order in Council INTRODUCTION On 10 July 2007 the Minister for Local Government, the Hon Richard Wynne MP, established a local government panel under section 220A of the Local Government Act 1989 (the Act) to conduct a review into the boundary between the municipal districts of the Melbourne City Council and the Moonee Valley City Council in the suburbs of Kensington and North Melbourne. As required by section 220P of the Act, the Minister has considered the report of the panel on the review and has recommended to the Governor in Council that an Order in Council be made on the following terms. ORDER The Governor in Council under sections 220Q, 220R and 220S of the Act hereby orders that: 1. Definitions ‘Act’ means the Local Government Act 1989. ‘Annexed area’ means an area which as a result of this Order forms part of the municipal district of the Melbourne City Council and which immediately before the commencement of this Order formed part of the Moonee Valley City Council. ‘Appointed day’ means the day on which this Order comes into operation. ‘Flemington public housing estate’ means all properties in the area bounded by Debneys Park, Racecourse Road and Victoria Street, Flemington, under the control of the Victorian Department of Human Services.
Victoria Government Gazette G 50 13 December 2007 3093 ‘North Melbourne public housing estate’ means all properties in the area bounded by Alfred Street, Melrose Street, Canning Street and Boundary Road, North Melbourne, under the control of the Victorian Department of Human Services. ‘Racecourse Road retail centre’ means the retail centre generally in the vicinity of the Newmarket railway station. 2. Commencement This Order comes into operation on 1 July 2008. 3. Boundaries 3.1 On the appointed day, the municipal boundary of the Melbourne City Council shall be altered and fixed as described in Schedule 1; 3.2 On the appointed day, the municipal boundary of the Moonee Valley City Council shall be altered and fixed as described in Schedule 2. 4. General – Transitional Provisions 4.1 The Moonee Valley City Council and Melbourne City Council must come to an agreement on the apportionment, settlement, transfer, adjustment or determination of any property, income, assets, liabilities, expenses, staff or other matters in relation to the annexed area within ninety days of the appointed day. 5. Rating – Transitional provisions 5.1 Despite anything to the contrary in the Act, a person is liable to pay the Melbourne City Council any rates and charges declared by the Moonee Valley City Council under section 158 of the Act prior to the appointed day in respect of land in the annexed area as if the land in the annexed area were still part of the municipal district of the Moonee Valley City Council. 5.2 The Melbourne City Council must pay the Moonee Valley City Council all amounts under clause 5.1 received by it on and after the appointed day. 5.3 Any special rate or charge declared by the Moonee Valley City Council under section 163 of the Act concerning the Racecourse Road retail centre in force immediately prior to the appointed day and levied on any person liable to pay the special rate or charge with respect to a rateable property in the annexed area shall continue to apply to those persons and be levied by Moonee Valley City Council for the period it continues to remain in force. 5.4 General rates declared by the Melbourne City Council in respect of any non-residential land in the annexed area shall be declared as follows: Financial year Amount of general rate 2008/09 No greater than 110 per cent of the general rates for that land declared by the Moonee Valley City Council for the 2007/08 financial year. 2009/10 No greater than 120 per cent of the general rates for that land declared by the Moonee Valley City Council for the 2007/08 financial year. 2010/11 No greater than 130 per cent of the general rates for that land declared by the Moonee Valley City Council for the 2007/08 financial year.
