Current staff are acutely aware of the lack<br />
of access that male clients have to a male<br />
worker.<br />
This exemption attempts to redress that<br />
imbalance to a more appropriate need.<br />
The Tribunal hereby grants an exemption<br />
to the applicant from the operation of sections<br />
13, 100 and 195 of the Equal Opportunity Act<br />
1995 to enable the applicant to engage in the<br />
exempt conduct.<br />
This exemption is to remain in force from<br />
the day on which notice of the exemption is<br />
published in the <strong>Government</strong> <strong>Gazette</strong> until<br />
1 December 2010.<br />

EXEMPTION<br />
Application No. A350/2007<br />
The <strong>Victoria</strong>n Civil and Administrative<br />
Tribunal has considered an application, pursuant<br />
to section 83 of the Equal Opportunity Act 1995,<br />
by Healesville High School. The application<br />
for exemption is to enable the applicant to<br />
advertise and employ an Aboriginal or Torres<br />
Strait Indigenous male dance coordinator (the<br />
exempt conduct).<br />
Upon reading the material submitted in<br />
support of the application the Tribunal is satisfied<br />
that it is appropriate to grant an exemption from<br />
sections 13, 100 and 195 of the Act to enable the<br />
applicant to engage in the exempt conduct.<br />
In granting this exemption the Tribunal<br />
noted:<br />
The Healesville School is implementing an<br />
Indigenous dance program for students at the<br />
school.<br />
Local Traditional owners and Community<br />
Elders advise that it is essential that a<br />
male person of Aboriginal or Torres Strait<br />
descent would maintain the cultural integrity<br />
and appropriateness necessary to be the<br />
Indigenous male dance coordinator.<br />
Without the proper cultural integrity and<br />
appropriateness, the program would fail to<br />
achieve its many stipulated outcomes and<br />
benefits.<br />
The Tribunal hereby grants an exemption<br />
to the applicant from the operation of sections<br />
13, 100 and 195 of the Equal Opportunity Act<br />
1995 to enable the applicant to engage in the<br />
exempt conduct.<br />
This exemption is to remain in force from<br />
the day on which notice of the exemption is<br />
published in the <strong>Government</strong> <strong>Gazette</strong> until<br />

NOTICE REGARDING THE AMENDMENT,<br />
COMMENCEMENT AND AVAILABILITY<br />
OF THE POISONS CODE<br />
I, Daniel Andrews, Minister for Health, give<br />
notice that the Poisons Code, prepared under<br />
sections 12 and 12E of the Drugs, Poisons and<br />
Controlled Substances Act 1981 (the Act), will<br />
be amended.<br />
The Act enables the Poisons Code to contain<br />
in the Poisons List (a) a list of Schedule 1<br />
poisons, (b) a list of any of the substances in<br />
Schedule 1 of the Poisons List or Schedules<br />
2 to 9 of the Commonwealth standard or the<br />
Appendices to the Commonwealth standard that<br />
are not for general sale by retail, and (c) a list<br />
of exemptions from Schedule 1 of the Poisons<br />
List or Schedules 2 to 9 of the Commonwealth<br />
standard.
