Frequently Asked Questions Injured worker benefits What is insurance for lost income If your worker misses time from work because of a workrelated injury or illness, the insurance will provide payments for his or her loss of earnings (LOE). The amount paid for lost income is based on 85 per cent of your worker’s pre-injury take home pay, less any earnings after the injury, up to an annual maximum. For injuries before January 1, 1998, see the chart on page 9. What if I disagree with a decision about a claim You have the right to object to any decision made by a WSIB staff member. Review the process for objecting in Chapter 7, Appealing a WSIB decision. How long can a worker receive loss of earnings payments The LOE benefit ■ begins the day after the injury or whenever the wage loss starts. As the employer, you must pay the full day’s wages on the day of injury. ■ stops when your worker ■ ■ recovers from the injury returns to work and earns the same or more than what he or she previously made, or ■ turns 65 years old. But for workers who are 63 or older at the time of the injury, the LOE benefit can be paid for up to two years, as long as the worker has a loss of earnings because of the workplace injury or illness. What is a material change Anything that affects a worker’s injury, employment or earnings. The worker must report any material change to us within 10 days of the change. Failing to report may affect benefits or even result in charges. Does the WSIB change benefits to reflect changes in the worker's income from year to year We can review an LOE benefit every year, or when a material change occurs in your worker’s circumstances, until six years after the injury. Reviews and changes to the LOE benefit stop after six years, unless the worker did not report a material change. If, after a labour market re-entry assessment or plan, the worker shows the potential to still earn as much or more than before the injury, the benefit stops. What is early and safe return to work This term refers to actions taken by workplace parties (employers and workers) to bring the worker back to work following a workplace injury or illness. Most workers return to work while still recovering, and may need to ■ work reduced hours ■ avoid certain duties, or ■ do different work temporarily. The focus is on activities you and your worker need to do to get the worker back to work safely and as early as possible, at little or no loss of earnings, with minimal risk to the worker or to co-workers. 10 Employers must report a workplace injury within three days of learning about it.
