LCvR7.2 Briefs for Bankruptcy Appeals.<br />

(a) For a bankruptcy appeal, the appellant shall serve and file its brief within 15<br />

days after the transmission <strong>of</strong> the record to the Clerk <strong>of</strong> the <strong>District</strong> Court. The appellee shall<br />

serve and file its brief within 15 days after service <strong>of</strong> the brief <strong>of</strong> the appellant. The appellant<br />

may serve and file a reply brief within 10 days after service <strong>of</strong> the brief <strong>of</strong> the appellee.<br />

Unless otherwise stated in this local rule, briefs for an appeal from the bankruptcy court are<br />

governed by the rules found at LCvR7.1.<br />

(b) Unless otherwise ordered by the Court, oral argument as required by<br />

Fed R. Bankr. P. 8012 is excused.<br />

LCvR9.1 Notice Requirement for 3-Judge Court.<br />

In any action or proceeding which a plaintiff believes is required to be heard by a 3-<br />

judge court under 28 U.S.C. § 2284, the plaintiff shall file with the complaint a separate<br />

notice, or the equivalent thereto, to the Court, stating that a 3-judge court is requested. If the<br />

plaintiff fails to give such notice, every other party shall file such notice, provided that as<br />

soon as a notice is filed by any party, all other parties are relieved <strong>of</strong> this obligation.<br />

LCvR9.2 Actions Brought by Incarcerated Persons.<br />

Petitions for writs <strong>of</strong> habeas corpus, motions to vacate sentence pursuant to 28 U.S.C.<br />

§ 2255, and civil rights complaints pursuant to 42 U.S.C. § 1983 or Bivens v. Six Unknown<br />

Named Agents, 403 U.S. 388 (1971), by persons in state or federal custody, shall be on forms<br />

provided by the Clerk <strong>of</strong> this Court upon request. Failure to use said forms or to supply the<br />

Court with the equivalent information required by the forms will result in the pleading being<br />

ordered stricken.<br />

Petitioners or movants seeking post-conviction relief shall send or deliver to the Clerk<br />

the original and two copies <strong>of</strong> the petition or motion. Plaintiffs submitting complaints for<br />

civil rights relief must submit the original and one copy <strong>of</strong> the complaint for the Court and<br />

one copy for each <strong>of</strong> the persons named as defendant in the complaint. If tendered for filing<br />
