B. <strong>LOCAL</strong> CRIMINAL <strong>RULES</strong><br />
I. SCOPE, PURPOSE AND CONSTRUCTION.<br />
LCrR1.1 Purpose and Scope <strong>of</strong> Rules.<br />
These local criminal rules are promulgated to supplement the Federal Rules <strong>of</strong> Criminal<br />
Procedure with local court procedure not to be inconsistent with the federal rules. These rules<br />
shall apply to all proceedings in criminal actions. The numbering scheme <strong>of</strong> the local criminal<br />
rules tracks the numbers and supplements the content <strong>of</strong> the Federal Rules <strong>of</strong> Criminal<br />
Procedure. Appendix I <strong>of</strong> the Local Court Rules contains a listing <strong>of</strong> General Orders which<br />
are available from the Court Clerk on request. These orders are issued by the Court to establish<br />
procedures on administrative matters and less routine matters that do not affect the majority<br />
<strong>of</strong> practitioners before this Court. Appendix V contains the form for Joint Statement <strong>of</strong><br />
Discovery Conference.<br />
LCrR1.2 Rules <strong>of</strong> Procedure.<br />
(a) The rules <strong>of</strong> procedure in any criminal proceeding in this Court shall be as<br />
prescribed by the Constitution and the laws <strong>of</strong> the United States, the rules <strong>of</strong> the Supreme<br />
Court <strong>of</strong> the United States, the Federal Rules <strong>of</strong> Criminal Procedure, any applicable rules <strong>of</strong><br />
the United States Court <strong>of</strong> Appeals for the Tenth Circuit, and these local criminal court rules.<br />
(b) Where in any proceeding or in any instance there is no applicable rule <strong>of</strong><br />
procedure, a judge may prescribe the same.<br />
(c) The trial judge has discretion in any criminal case to waive any requirement <strong>of</strong><br />
these local rules when the administration <strong>of</strong> justice requires.<br />
