7. Conclusion <strong>and</strong> Ma<strong>in</strong> F<strong>in</strong>d<strong>in</strong>gs<br />
It is evident from this research that the Crim<strong>in</strong>al Law (Amendment) Act<br />
2004 has not had the desired impact. Nevertheless, one cannot say that it<br />
has had no effect at all. The positive <strong>and</strong> negative impacts <strong>of</strong> the law are<br />
discussed below.<br />
The law has def<strong>in</strong>itely not put an end to honour kill<strong>in</strong>gs, nor can it be<br />
seen to have drastically reduced it. In fact, accord<strong>in</strong>g to sections <strong>of</strong> the<br />
community, <strong>in</strong>cidence has actually <strong>in</strong>creased <strong>in</strong>stead <strong>of</strong> decreas<strong>in</strong>g. The<br />
community <strong>and</strong> parts <strong>of</strong> civil society rema<strong>in</strong> ignorant about the law <strong>and</strong><br />
its substance, thereby immediately reduc<strong>in</strong>g its potential impact. The<br />
motives beh<strong>in</strong>d honour kill<strong>in</strong>gs rema<strong>in</strong> the same pre-2004 to post–2004.<br />
In fact, seem<strong>in</strong>gly, there has been an <strong>in</strong>crease <strong>in</strong> the use <strong>of</strong> the pretext <strong>of</strong><br />
honour kill<strong>in</strong>gs because <strong>of</strong> some exemptions that are available under the<br />
honour kill<strong>in</strong>g law. This is because the case law has now started us<strong>in</strong>g<br />
honour kill<strong>in</strong>gs as a mitigat<strong>in</strong>g factor for punishments awarded, thereby<br />
one can get a m<strong>in</strong>imum sentence due to the discretion <strong>of</strong> the court.<br />
There are some positive factors too. While the law may not have had the<br />
immediate effect <strong>of</strong> mak<strong>in</strong>g the community aware <strong>of</strong> the evils <strong>of</strong> this<br />
tradition, nor <strong>of</strong> actually stopp<strong>in</strong>g the practice, it has resulted <strong>in</strong> the issue<br />
be<strong>in</strong>g taken out from the home, brought <strong>in</strong>to the public realm <strong>and</strong> onto the<br />
front page <strong>of</strong> the ma<strong>in</strong> news. Increas<strong>in</strong>g report<strong>in</strong>g <strong>of</strong> honour kill<strong>in</strong>gs puts<br />
the spotlight on this social evil, stat<strong>in</strong>g it to be wrong <strong>and</strong> tragic. This has<br />
resulted <strong>in</strong> creat<strong>in</strong>g <strong>in</strong> the community, to some extent, albeit a small but<br />
def<strong>in</strong>ite attitud<strong>in</strong>al change that can be seen <strong>in</strong> the grow<strong>in</strong>g <strong>in</strong>tolerance to<br />
such murders. On the national <strong>and</strong> <strong>in</strong>ternational level it is understood that<br />
these crimes are wrong <strong>and</strong> are he<strong>in</strong>ous <strong>in</strong> nature. The m<strong>in</strong>dset is slowly<br />
chang<strong>in</strong>g to consider honour kill<strong>in</strong>gs to be wrong. This attitude needs to<br />
s<strong>in</strong>k deeper <strong>in</strong> the m<strong>in</strong>d <strong>of</strong> the community before any social change can<br />
