City of Murrieta SWMP<br />

3.4 LEGAL AUTHORITY<br />

The City of Murrieta is revising the NPDES ordinance to specifically address all of the new requirements<br />

outlined in the NPDES Permit. A certification of the City of Murrieta’s adequate legal authority to<br />

comply with 40 CFR 122.26(d)(2)(I)(A-F) and the Third-term MS4 Permit associated with the new<br />

ordinance will be provided upon adoption of the new ordinance in July <strong>2005</strong>. This certification will be<br />

similar the certification submitted with the 2004 Annual Report provided in Appendix A.<br />

The Urban Runoff management and discharge controls addressed by the City of Murrieta’s ordinances<br />

may be summarized as follows:<br />

♦ The disposal of pollutants onto public or private land is prohibited.<br />

♦ Construction activities are required to comply with the local storm water ordinance, the<br />

applicable erosion and sediment control (grading) ordinance, and minimum best management<br />

practices (BMPs).<br />

♦ Priority Development Projects 1 are required to implement BMPs to reduce pollutants to the<br />

MEP and to maintain or reduce downstream erosion and protect stream habitat.<br />

♦ Illicit connections to the MS4 are prohibited.<br />

♦ Illegal Discharges to the MS4 are prohibited. Illegal discharges are discharges to the MS4<br />

other than those permitted by the Regional Board and those non-stormwater discharges as<br />

identified in Section B.2 of the Third-term MS4 Permit and Section 4.1 of this SWMP.<br />

♦ Stop work orders, non-monetary penalties, fines, financial security (bonds), and the denial or<br />

revocation of permits may be imposed for violation of permit conditions or ordinances.<br />

Table 3-2 lists the ordinances that provide this legal authority.<br />
