<strong>The</strong> <strong>Dalits</strong> <strong>of</strong> <strong>Nepal</strong> <strong>and</strong><br />

a <strong>New</strong> <strong>Constitution</strong><br />

(4A) as a separate class <strong>of</strong> vacancies to be filled<br />

up in any succeeding year or years <strong>and</strong> such<br />

class <strong>of</strong> vacancies shall not be considered<br />

together with the vacancies <strong>of</strong> the year in<br />

which they are being filled up for determining<br />

the ceiling <strong>of</strong> fifty per cent reservation on total<br />

number <strong>of</strong> vacancies <strong>of</strong> that year.<br />

(5) Nothing in this article shall affect the operation <strong>of</strong><br />

any law which provides that the incumbent <strong>of</strong> an<br />

<strong>of</strong>fice in connection with the affairs <strong>of</strong> any religious<br />

or denominational institution or any member <strong>of</strong> the<br />

governing body there<strong>of</strong> shall be a person pr<strong>of</strong>essing<br />

a particular religion or belonging to a particular<br />

denomination.<br />

17. Abolition <strong>of</strong> Untouchability —”Untouchability’’ is abolished<br />

<strong>and</strong> its practice in any form is forbidden. <strong>The</strong> enforcement<br />

<strong>of</strong> any disability arising out <strong>of</strong> “Untouchability’’ shall be an<br />

<strong>of</strong>fence punishable in accordance with law.<br />

Right against Exploitation<br />

23. Prohibition <strong>of</strong> traffic in human beings <strong>and</strong> forced<br />

labour —<br />

(1) Traffic in human beings <strong>and</strong> begar <strong>and</strong> other similar<br />

forms <strong>of</strong> forced labour are prohibited <strong>and</strong> any<br />

contravention <strong>of</strong> this provision shall be an <strong>of</strong>fence<br />

punishable in accordance with law.<br />

(2) Nothing in this article shall prevent the State from<br />

imposing compulsory service for public purposes,<br />

<strong>and</strong> in imposing such service the State shall not<br />

make any discrimination on grounds only <strong>of</strong> religion,<br />

race, caste or class or any <strong>of</strong> them.<br />

29. Protection <strong>of</strong> interests <strong>of</strong> minorities —<br />

(1) Any section <strong>of</strong> the citizens residing in the territory<br />

<strong>of</strong> India or any part there<strong>of</strong> having a distinct<br />

language, script or culture <strong>of</strong> its own shall have the<br />

right to conserve the same.<br />

(2) No citizen shall be denied admission into any<br />

educational institution maintained by the State or<br />

receiving aid out <strong>of</strong> State funds on grounds only <strong>of</strong><br />

religion, race, caste, language or any <strong>of</strong> them.<br />

46. Promotion <strong>of</strong> educational <strong>and</strong> economic interests <strong>of</strong><br />

Scheduled Castes, Scheduled Tribes <strong>and</strong> other weaker<br />

sections — <strong>The</strong> State shall promote with special care the<br />

educational <strong>and</strong> economic interests <strong>of</strong> the weaker<br />

sections <strong>of</strong> the people, <strong>and</strong>, in particular, <strong>of</strong> the Scheduled<br />

Castes <strong>and</strong> the Scheduled Tribes, <strong>and</strong> shall protect them<br />

from social injustice <strong>and</strong> all forms <strong>of</strong> exploitation.<br />

243D. Reservation <strong>of</strong> seats —<br />

(1) Seats shall be reserved for —<br />

(a) the Scheduled Castes; <strong>and</strong><br />

(b) the Scheduled Tribes,<br />

in every Panchayat <strong>and</strong> the number <strong>of</strong> seats so reserved<br />

shall bear, as nearly as may be, the same proportion to<br />

the total number <strong>of</strong> seats to be filled by direct election<br />

in that Panchayat as the population <strong>of</strong> the Scheduled<br />

Castes in that Panchayat area or <strong>of</strong> the Scheduled Tribes<br />

in that Panchayat area bears to the total population <strong>of</strong><br />

that area <strong>and</strong> such seats may be allotted by rotation to<br />

different constituencies in a Panchayat.<br />

(2) Not less than one-third <strong>of</strong> the total number <strong>of</strong> seats<br />

reserved under clause (1) shall be reserved for<br />

women belonging to the Scheduled Castes or, as<br />

the case may be, the Scheduled Tribes.<br />

(3) Not less than one-third (including the number <strong>of</strong> seats<br />

reserved for women belonging to the Scheduled Castes<br />

<strong>and</strong> the Scheduled Tribes) <strong>of</strong> the total number <strong>of</strong> seats<br />

to be filled by direct election in every Panchayat shall<br />

be reserved for women <strong>and</strong> such seats may be allotted<br />

by rotation to different constituencies in a Panchayat.<br />

(4) <strong>The</strong> <strong>of</strong>fices <strong>of</strong> the Chairpersons in the Panchayats at<br />

the village or any other level shall be reserved for<br />

the Scheduled Castes, the Scheduled Tribes <strong>and</strong><br />

women in such manner as the Legislature <strong>of</strong> a State<br />

may, by law, provide:<br />

Provided that the number <strong>of</strong> <strong>of</strong>fices <strong>of</strong> Chairpersons<br />

reserved for the Scheduled Castes <strong>and</strong> the<br />

Scheduled Tribes in the Panchayats at each level<br />

in any State shall bear, as nearly as may be, the<br />

same proportion to the total number <strong>of</strong> such <strong>of</strong>fices<br />

in the Panchayats at each level as the population<br />

<strong>of</strong> the Scheduled Castes in the State or <strong>of</strong> the<br />

Scheduled Tribes in the State bears to the total<br />

population <strong>of</strong> the State:<br />

Provided further that not less than one-third <strong>of</strong> the<br />

total number <strong>of</strong> <strong>of</strong>fices <strong>of</strong> Chairpersons in the<br />

Panchayats at each level shall be reserved for women:<br />

Provided also that the number <strong>of</strong> <strong>of</strong>fices reserved<br />

under this clause shall be allotted by rotation to<br />

different Panchayats at each level.<br />

(5) <strong>The</strong> reservation <strong>of</strong> seats under clauses (1) <strong>and</strong> (2)<br />

<strong>and</strong> the reservation <strong>of</strong> <strong>of</strong>fices <strong>of</strong> Chairpersons (other<br />

than the reservation for women) under clause (4)<br />

shall cease to have effect on the expiration <strong>of</strong> the<br />

period specified in article 334.
