(2) Parliament may by law include in or exclude from<br />

the list <strong>of</strong> Scheduled Castes specified in a notification<br />

issued under clause (1) any caste, race or tribe or<br />

part <strong>of</strong> or group within any caste, race or tribe, but<br />

save as aforesaid a notification issued under the<br />

said clause shall not be varied by any subsequent<br />

notification.<br />

Right to equality<br />

12. (1) All persons are equal before the law <strong>and</strong> are<br />

entitled to the equal protection <strong>of</strong> the law.<br />

(2) No citizen shall be discriminated against on the<br />

grounds <strong>of</strong> race, religion, language, caste, sex,<br />

political opinion, place <strong>of</strong> birth or any such grounds:<br />

Provided that it shall be lawful to require a person<br />

to acquire within a reasonable time sufficient<br />

knowledge <strong>of</strong> any language as a qualification for<br />

any employment or <strong>of</strong>fice in the Public, Judicial or<br />

Local Government Service or in the service <strong>of</strong> any<br />

public corporation, where such knowledge is<br />

reasonably necessary for the discharge <strong>of</strong> the duties<br />

<strong>of</strong> such employment or <strong>of</strong>fice:<br />

Provided further that it shall be lawful to require a<br />

person to have sufficient knowledge <strong>of</strong> any<br />

language as a qualification for any such employment<br />

<strong>of</strong> <strong>of</strong>fice where no function <strong>of</strong> that employment or<br />

<strong>of</strong>fice can be discharged otherwise than with a<br />

knowledge <strong>of</strong> that language.<br />

(3) No person shall, on the grounds <strong>of</strong> race, religion,<br />

language, caste, sex or any one such grounds, be<br />

subject to any disability, liability, restriction or<br />

condition with regard to access to shops, public<br />

restaurants, hotels, places <strong>of</strong> public entertainment<br />

<strong>and</strong> places <strong>of</strong> public worship <strong>of</strong> his own religion.<br />

(4) Nothing in this Article shall prevent special provision<br />

being made, by law, subordinate legislation or<br />

executive action, for the advancement <strong>of</strong> women,<br />

children or disabled persons.<br />

<strong>The</strong> <strong>Constitution</strong> <strong>of</strong> Bangladesh<br />

This has a somewhat similar provision. It also provides:<br />

29. Equality <strong>of</strong> opportunity in public employment.<br />

(1) <strong>The</strong>re shall be equality <strong>of</strong> opportunity for all citizens<br />

in respect <strong>of</strong> employment or <strong>of</strong>fice in the service <strong>of</strong><br />

the Republic.<br />

(2) No citizen shall, on grounds only <strong>of</strong> religion, race,<br />

caste, sex or place <strong>of</strong> birth, be ineligible for, or<br />

discriminated against in respect <strong>of</strong>, any employment<br />

or <strong>of</strong>fice in the service <strong>of</strong> the Republic.<br />

(3) Nothing in this article shall prevent the State<br />

from -<br />

1. making special provision in favour <strong>of</strong> any backward<br />

section <strong>of</strong> citizens for the purpose <strong>of</strong> securing their<br />

adequate representation in the service <strong>of</strong> the<br />

Republic;<br />

2. giving effect to any law which makes provision for<br />

reserving appointments relating to any religious or<br />

denominational institution to persons <strong>of</strong> that religion<br />

or denomination;<br />

3. reserving for members <strong>of</strong> one sex any class <strong>of</strong><br />

employment or <strong>of</strong>fice on the ground that it is<br />

considered by its nature to be unsuited to members<br />

<strong>of</strong> the opposite sex.<br />

<strong>The</strong> <strong>Constitution</strong> <strong>of</strong> Pakistan<br />

22. Safeguards as to educational institutions in respect <strong>of</strong><br />

religion, etc.<br />

(3) Subject to law:<br />

(b) no citizen shall be denied admission to any<br />

educational institution receiving aid from public<br />

revenues on the ground only <strong>of</strong> race, religion,<br />

caste or place <strong>of</strong> birth.<br />

(4) Nothing in this Article shall prevent any public authority<br />

from making provision for the advancement <strong>of</strong> any socially<br />

or educationally backward class <strong>of</strong> citizens.<br />

26. Non-discrimination in respect <strong>of</strong> access to public<br />

places.<br />

(1) In respect <strong>of</strong> access to places <strong>of</strong> public entertainment<br />

or resort not intended for religious purposes only,<br />

there shall be no discrimination against any citizen<br />

on the ground only <strong>of</strong> race, religion, caste, sex,<br />

residence or place <strong>of</strong> birth.<br />

(2) Nothing in clause (1) shall prevent the State from<br />

making any special provision for women <strong>and</strong><br />

children.
