Each year, <strong>the</strong> OPC is allowed<br />
<strong>to</strong> use $250,000 or 5% of <strong>the</strong><br />
investment income from FICAV,<br />
whichever is less, <strong>to</strong> organize<br />
information <strong>and</strong> education<br />
activities for consumers.<br />
2.3 COMPENSATION FUND<br />
2.3.1 What is it for?<br />
Cus<strong>to</strong>mers benefit from ano<strong>the</strong>r source of protection. The law provi<strong>de</strong>s<br />
that FICAV (<strong>the</strong> Compensation Fund for Cus<strong>to</strong>mers of <strong>Travel</strong> Agents) is<br />
ma<strong>de</strong> available <strong>to</strong> compensate or reimburse cus<strong>to</strong>mers in cases where a<br />
travel agent’s individual security is ina<strong>de</strong>quate or <strong>the</strong> product supplier<br />
fails <strong>to</strong> provi<strong>de</strong> <strong>the</strong> cus<strong>to</strong>mer with <strong>the</strong> expected service, provi<strong>de</strong>d that<br />
<strong>the</strong> travel agent is not at fault. It is also used <strong>to</strong> pay administrative fees<br />
<strong>and</strong> expenses of <strong>the</strong> provisional administra<strong>to</strong>r, <strong>the</strong> person appointed <strong>to</strong><br />
look after cus<strong>to</strong>mer accounts in <strong>the</strong> event of an agency closure.<br />
Consequently, Mrs. Fairbro<strong>the</strong>r will be reimbursed or compensated by<br />
FICAV if <strong>the</strong> Fancyfree Agency Inc. has exhausted its individual security.<br />
2.3.2 Who has <strong>to</strong> contribute <strong>to</strong> FICAV?<br />
Contributions <strong>to</strong> <strong>the</strong> Compensation Fund for Cus<strong>to</strong>mers of <strong>Travel</strong> Agents<br />
(FICAV) are ma<strong>de</strong> by travel agency cus<strong>to</strong>mers, <strong>and</strong> are m<strong>and</strong>a<strong>to</strong>ry. You<br />
are <strong>the</strong> only party responsible for collecting <strong>the</strong> required FICAV contributions<br />
amounts from cus<strong>to</strong>mers. There is just one exception; although<br />
diplomats <strong>and</strong> diplomatic personnel have <strong>to</strong> pay <strong>the</strong> FICAV contribution,<br />
you may notify <strong>the</strong>m on <strong>the</strong>ir eligibility for a refund upon request.<br />
Applications are submitted <strong>to</strong> <strong>the</strong> OPC through <strong>the</strong> Quebec Minister of<br />
International Relations. Of course, anyone obtaining such a reimbursement<br />
will not be eligible for FICAV benefits.<br />
2.3.3 How much is <strong>the</strong> contribution?<br />
Your cus<strong>to</strong>mer pays a percentage of <strong>the</strong> pre-tax cost of <strong>to</strong>urist products<br />
purchased through your agency as a contribution <strong>to</strong> FICAV. The calculation<br />
does not inclu<strong>de</strong> service fees, travel insurance or travel accessories<br />
(e.g. purchase of <strong>to</strong>urist maps, travel gui<strong>de</strong>s, etc.). Consequently, Fancyfree<br />
Agency Inc. charged Mrs. Fairbro<strong>the</strong>r $15.43 in <strong>to</strong>urist services for FICAV.<br />
Table 2 indicates <strong>the</strong> amounts <strong>and</strong> contribution percentages based on<br />
accumulated surpluses in <strong>the</strong> Fund as at March 31 of each year.<br />
