Provided that the State Government shall, before making any such order, give<br />
the person concerned an opportunity of making a representation against the<br />
proposed order.<br />
2 9A. If a Pradhan or an Upa-Pradhan or an authority or a person referred to in<br />
sub-section (8) 3 [and sub-section (9)] of section 9 fails to comply with the<br />
provisions of that sub-section, he shall be punishable with imprisonment for a<br />
term which may extend to three years or liable to pay fine not exceeding two<br />
thousand rupees or both and the offence shall be cognizable:<br />
Provided that without prejudice to the foregoing penal provisions such default<br />
shall also be construed as a misconduct for which he may be debarred from<br />
standing as a candidate in any election in any capacity under this <strong>Act</strong> for such<br />
term as may be determined by the prescribed authority after giving the person<br />
concerned an opportunity of being heard and any order debarring him shall be in<br />
writing stating the reasons therefore and shall also be published in the Official<br />
Gazette.<br />

Gram panchyat)<br />
10. (1) A Pradhan or an Upa-Pradhan or a member of a Gram <strong>Panchayat</strong> may<br />
resign his office by notifying in writing his intention to do so to the prescribed<br />
authority and on such resignation being accepted the Pradhan, the Upa-Pradhan<br />
or the member shall be deemed to have vacated his office.<br />
(2) When a resignation is accepted under sub-section (1), the prescribed<br />
authority shall communicate it to the members of the Gram <strong>Panchayat</strong> within<br />
thirty days of such acceptance.<br />
11. (1) <strong>The</strong> prescribed authority may, after giving an opportunity to a member of<br />
a Gram <strong>Panchayat</strong> to show cause against the action proposed to be taken<br />
against him, by order remove him from office—<br />
(a) if after his election he is convicted by a criminal court of an offence involving<br />
moral turpitude and punishable with imprisonment for a period of more than six<br />
months; or<br />
