3 36A. Subject to the provisions of this <strong>Act</strong>, the rules made thereunder and to any<br />
general or special directions as the State Government may give in this behalf, the<br />
officers and other employees employed by the Gram <strong>Panchayat</strong> and the officers<br />
and other employees whose services have been placed at the disposal of the<br />
Gram <strong>Panchayat</strong> .shall exercise such powers, perform such functions and<br />
discharge such duties as the Gram <strong>Panchayat</strong> may determine.<br />
37. (1) For general watch and ward, prevention of crime, protection of life and<br />
property 6 [, running of office of the Gram <strong>Panchayat</strong>] and discharging all<br />
functions relevant thereto as hereinafter provided within the local limits of the<br />
jurisdiction of a Gram <strong>Panchayat</strong> every Gram <strong>Panchayat</strong> shall, unless otherwise<br />
directed or other provisions are made by the State Government, maintain under<br />
its control such number of 7 [Dafadars, Chowkidars and Gram <strong>Panchayat</strong><br />
Karmees] as the State Government may by general or special order determine.<br />
(2)<br />
1 [<strong>The</strong> manner of maintenance of Dafadars, Chowkidars and Gram <strong>Panchayat</strong><br />
Karmees by a Gram <strong>Panchayat</strong>,] the salary, allowances and gratuity to be paid to<br />
them and the nature and the cost of their equipment and all matters relating to<br />
their recruitment, conditions of service, superannuation, discipline, punishment<br />
and dismissal shall be determined in accordance with such rules as may be<br />
made: Provided that the Gram <strong>Panchayat</strong> shall have disciplinary control over<br />
\Dafadars, Chowkidars and Gram <strong>Panchayat</strong> Karmees.]<br />

38. <strong>The</strong> State Government may contribute to the Gram <strong>Panchayat</strong> Fund the<br />
entire or any part of the cost of maintenance of 3 [Dafadars, Chowkidars and<br />
Gram <strong>Panchayat</strong> Karmees] including the amount necessary for the payment of<br />
salary, allowances, provident fund and gratuity to 4 [Dafadars, Chowkidars and<br />
Gram <strong>Panchayat</strong> Karmees] and the amount necessary for their reward and<br />
equipment.<br />
39. (1)<br />
5 [Every Chowkidar or Gram <strong>Panchayat</strong> Karmee] shall exercise the<br />
following powers and perform the following duties, namely:—<br />
