The amount and type <strong>of</strong> wastes to be generated by <strong>the</strong> proposed use and <strong>the</strong> adequacy <strong>of</strong><br />

<strong>the</strong> proposed disposal system;<br />

The capability <strong>of</strong> <strong>the</strong> land and water to sustain such use without degradation;<br />

Topography and drainage <strong>of</strong> <strong>the</strong> site and susceptibility to flooding;<br />

The need <strong>of</strong> a particular location for <strong>the</strong> proposed use;<br />

The compatibility <strong>of</strong> <strong>the</strong> proposed use with adjacent land uses.<br />

The <strong>Plan</strong>ning Board also has <strong>the</strong> power to impose reasonable restrictions deemed advisable in<br />

order to protect <strong>the</strong> purity <strong>of</strong> <strong>the</strong> groundwater. Because this overlay district imposes a higher<br />

standard for <strong>the</strong> promotion and protection <strong>of</strong> health, safety and welfare, <strong>the</strong> provisions <strong>of</strong> this<br />

overlay district shall prevail.<br />

13.6 ANALYSIS OF TOOLS FOR THE PROTECTION OF DRINKING WATER<br />

The <strong>Town</strong> has a Capital Improvements Program designed to identify deficiencies and<br />

recommend upgrades to public utilities such as water and sewer. The CIP is a vital physical and<br />

financial planning tool, and is designed to provide priorities for <strong>the</strong> long-term maintenance and<br />

improvement <strong>of</strong> public utilities, facilities and services which <strong>the</strong> <strong>Town</strong> provides for its citizens.<br />

<strong>Wolfeboro</strong> has a newly upgraded Waste Water Treatment Facility. The previous facility was<br />

constructed in <strong>the</strong> early 1970s, and was occasionally unable to comply with NHDES declared<br />

spray rate limits. In order to solve this problems, in 2008 <strong>the</strong> <strong>Town</strong> constructed a new Waste<br />

Water Treatment Facility. This facility pumps up to 600-thousand gallons <strong>of</strong> treated wastewater<br />

each day, and it will remove more nitrogen from <strong>the</strong> water before it‟s pumped up <strong>the</strong> hill to <strong>the</strong><br />

new basins. Trace amount <strong>of</strong> phosphorus will remain in <strong>the</strong> water but should be filtered out<br />

through <strong>the</strong> sandy basins.<br />

<strong>Wolfeboro</strong> protects all wastewater pollution from entering groundwater resources in an<br />

ordinance on sewage maintenance. The ordinance also prohibits any waste product from entering<br />

natural outlets. A permit is required for any construction <strong>of</strong> private sewage disposal systems.<br />

No use <strong>of</strong> any land or structure in <strong>the</strong> <strong>Town</strong> <strong>of</strong> <strong>Wolfeboro</strong> shall be permitted which generates any<br />

waste which has been identified as a "hazardous and toxic waste" by <strong>the</strong> State <strong>of</strong> New Hampshire<br />

Office <strong>of</strong> Waste Management or by <strong>the</strong> United States Environmental Protection Agency until a<br />

permit for such use has been obtained from <strong>the</strong> <strong>Plan</strong>ning Board.<br />

For all development ordinances subdivision ordinances and personal wireless facilities,<br />

stormwater run<strong>of</strong>f is required to be contained on-site. Also, no hazardous waste shall be<br />

discharged on <strong>the</strong> site <strong>of</strong> any personal wireless service facility. If any hazardous materials are to<br />

be used on site, <strong>the</strong>re shall be provisions for full containment <strong>of</strong> such materials. An enclosed<br />
