Georgia’s Disaster Resilient<br />

Building Code Embraces APA<br />

Recommendations<br />

The State of Georgia is using APA<br />

recommendations for wind-resistant<br />

construction in prescriptive building<br />

provisions, which were passed by the<br />

State Code Advisory Committee this<br />

week. The U.S. Department of<br />

Housing and Urban Development<br />

(HUD) awarded a grant to the Georgia<br />

Department of Community Affairs<br />

(DCA) to develop Disaster Resilient<br />

Building Code appendices to the<br />

state’s building and residential codes.<br />

The optional appendices include<br />

heightened requirements for both<br />

flood and wind resistant construction<br />

which, if adopted by jurisdictions,<br />

would make wood systems more valuable<br />

to builders and homeowners.<br />

A DCA appointed task force chose to<br />

use recommendations found in APA’s<br />

publication, “Building for High Wind<br />

Resistance in Light-Frame Wood<br />

Construction” to create prescriptive<br />

building provisions in addition to<br />

known design methods such as the<br />

Wood Frame Construction Manual.<br />

The task force placed a high value on<br />

APA’s cost effective, commonsense<br />

approach to improving the durability of<br />

the structure and supported APA’s<br />

recommendations throughout the<br />

code development process.<br />

Representatives for the Foam<br />

Sheathing Coalition, the American<br />

Chemical Council and a metal connector<br />

manufacturer challenged the<br />

recommendations for full sheathing<br />

with wood structural panels, but their<br />

rationale was rejected by the State<br />

Codes Advisory Committee, which<br />

approved the appendix at their meeting<br />

on July 26, 2012.<br />

APA and AWC staff worked closely<br />

with Georgia DCA and the Task Force<br />

to make sure that the code language<br />

was appropriate for use in the appendix<br />

of the building code. APA will continue<br />

to work with the Georgia DCA to<br />

assist with any technical or other challenges<br />

that may occur at an upcoming<br />

planned public hearing, which will be<br />

held prior to final code adoption on<br />

Nov. 7, 2012.<br />

Supreme Court Reviews<br />

Forest Roads Case<br />

The U.S. Supreme Court recently<br />

announced it would review NEDC v.<br />

Brown, the Ninth Circuit ruling that<br />

logging roads are “industrial facilities”<br />

subject to the National Pollutant<br />

Discharge Elimination System<br />

(NPDES) requirements of the Clean<br />

Water Act (CWA). That decision invalidated<br />

Environmental Protection<br />

Agency (EPA) regulations that have<br />

been in place since 1976. Those rules<br />

regulate forest roads as non-point<br />

sources under a Best Management<br />

Practices (BMP) system.<br />

According to the American Forest<br />

Resource Council (AFRC), there are<br />

two separate appeals that will be con-<br />

solidated for argument, the State of<br />

Oregon’s (Decker v. Northwest<br />

Environmental Defense Fund) and<br />

industry’s (Georgia-Pacific West v.<br />

NEDC). The questions the Supreme<br />

Court has asked the appellants to<br />

address in their briefing focus on<br />

whether runoff from logging roads<br />

should be regulated as industrial<br />

storm water and whether the Ninth<br />

Circuit should have deferred to EPA.<br />

Oral argument is likely to be scheduled<br />

in late November or early<br />

December. The Court’s ruling is likely<br />

to be announced in the spring of<br />

2013.<br />

Gibson Guitars Case Resolved<br />

Gibson Guitars, headquartered in<br />

Nashville, Tenn., recently resolved a<br />

long-running dispute with the Justice<br />

Department over questionable fingerboard<br />

shipments. According to Fox<br />

News, the Justice Department<br />

announced that Gibson entered a<br />

“criminal enforcement agreement,”<br />

which resolved the investigation. Fox<br />

stated the federal government will not<br />

charge Gibson, but the company has<br />

reportedly agreed to pay a $300,000<br />

penalty, $50,000 to a federal conservation<br />

fund and withdraw claims to the<br />

valuable fingerboards that were<br />

seized in a series of federal raids.<br />

Centered around the Lacey Act, the<br />

series of federal raids on Gibson’s factories<br />

in 2009 and again in 2011 were<br />

prompted by shipments of unfinished<br />

wood from Madagascar. In the Indian<br />

case court documents said one intercepted<br />

shipment was “falsely” labeled<br />

as finished when it wasn’t.<br />

Recent reports from the Justice<br />

Department stated Gibson had<br />

acknowledged that it “failed to act on<br />

information” and the ebony imported<br />

from Madagascar “may have violated<br />

laws.”<br />

At press time an official statement<br />

from Gibson had not been released.<br />

Forestry Provisions for Farm Bill<br />

The House Agriculture Committee<br />

completed its work on legislation<br />

reauthorizing the Farm Bill, which<br />

includes several important forestry<br />

provisions that apply to federal lands.<br />

The markup contained several forest<br />

related amendments, including a successful<br />

amendment from<br />

Representative Kristi Noem (R-SD)<br />

that would allow the Forest Service to<br />

categorically exclude forest health<br />

treatments on lands identified as “critical<br />

areas” for projects up to 10,000<br />

acres. The underlying legislation originally<br />

limited that categorical exclusion<br />

to 1,000 acres. Other significant provisions<br />

in the bill include:<br />

• Stewardship contracting, which is<br />

due to expire in 2013, would be<br />

extended to 2017.<br />

• Expansion of the Good Neighbor<br />

Authority, which is currently a pilot in<br />

Colorado, will expand to include all<br />

National Forest System lands. This<br />

would allow for the Forest Service to<br />

contract with states to do hazardous<br />

fuels reduction and other projects on<br />

the National Forests.<br />

• Authorizes expedited treatments for<br />

Idaho Forest Group continues to invest significantly in computerized<br />

and central Idaho’s vast acreage of forests.<br />

“We like our supply here in the Intermountain West,” said Erol Deren, VP<br />

of sales for Idaho Forest Group. “We get a special kind of fiber resulting<br />

NORTH CAL WOOD PRODUCTS: “You Click It, They Ship It”<br />

Finely crafted pieces of lattice atop the pictured fence panels are an<br />

example of the products crafted from Redwood, Western Red Cedar and<br />

Douglas Fir at the Ukiah, Calif.-based plant owned and operated by North<br />

Cal Wood Products.<br />

Ukiah, Calif.–North Cal Wood Products Inc. has been<br />

one of the leading manufacturers of the value-added<br />

Redwood product for nearly three decades in the<br />

California marketplace. Today, it purchases well in<br />

excess of 100,000 board feet of Redwood, Western Red<br />

Cedar and Douglas Fir.<br />

North Cal procures new, 100% FSC-certified lumber, as<br />

well as some reclaimed lumber, to make siding, decking,<br />

fencing, lattice and garden products at the firm’s Ukiah<br />

facility. Those products are sold to various supply chains<br />

and retail lumberyards. End users include residential<br />

and commercial customers from Coast to Coast.<br />

“We sell direct and we use a distribution network,” said<br />

Tony Fernandez, North Cal’s vice<br />

president of sales and operations,<br />

who foresees a time in the near future<br />

when the Internet will play a larger<br />

role in that distribution. “As part of our<br />

online strategy, we’re looking to set up<br />

distribution facilities across the U.S.<br />

and tying them into our online offerings.”<br />

Historically a proven innovator, this<br />

month North Cal Wood Products<br />

rolled out a full-service, online lumber<br />

store called YouClickItWeShipIt.com.<br />

The lumber manufacturer is ramping<br />

up its new “You Click It, We Ship It”<br />

campaign with an eye on creating the<br />

lumber industry’s version of<br />

Amazon.com. YouClickItWeShipIt.com<br />

allows anyone to browse through the<br />

firm’s line of lumber inventory options<br />

via the web, select their preferences,<br />

place their orders, and have their<br />

selections shipped – all without having<br />

to pick up the phone or send a fax.<br />

The site also allows anyone to<br />

become a member with discounts to<br />

contractors, builders and architects.<br />

Fernandez said the 28-employee firm<br />

decided to launch its online store in<br />

order to serve its broadening client<br />

base in the most seamless manner<br />

possible, and to fill what he describes<br />

as a current void in the marketplace.<br />

“It’s an online world where customers<br />

are buying virtually everything on the<br />

Internet,” said Fernandez. “While other<br />

companies offer lumber products<br />

online, we offer something unique and<br />

compelling for the do-it-yourself client<br />

- direct shipping with no minimum<br />

order requirement.”<br />

YouClickItWeShipIt.com is just one of<br />

many customer-oriented moves the<br />

company has made since it was purchased<br />

by Frank Van Vranken (current<br />

president) in 1985. An electrician by<br />

trade, Van Vranken grew the company<br />

from a tiny $750,000 remanufacturing<br />

firm in its infancy to a $33 million<br />

organization in 10 years.<br />

In the 1990s North Cal became one<br />

of the first firms to service Home<br />

Depots with Redwood lumber and<br />

garden products.<br />

North Cal Wood Products operates<br />

from a 14-acre site that includes a<br />

manufacturing plant, an ample yard<br />

space to accommodate its large<br />

inventory and an FSC-certified lumber<br />

mill. Fernandez and three reps handle<br />

sales. The team works primarily with<br />

North American customers, but also<br />

sells to international clients.<br />

As North Cal Wood Products launches its online Internet “You Click It,<br />

We Ship It” campaign, customers can browse and select from hundreds<br />

of Softwood products to complement their home, such as the accent<br />

beams here, or build a deck or fence.<br />
