comment on <strong>the</strong> initial priority list identified by <strong>the</strong> LU, but would have to record on<br />
Elmer <strong>the</strong> reason for not wanting a particular SAR recommended by <strong>the</strong> LU to be<br />
developed.<br />
8.4.7 The LEA may also request that any <strong>of</strong> <strong>the</strong> SARs identified by <strong>the</strong> LU as intelligence only<br />
is developed into a full package. This should allow an individual LEA’s local knowledge<br />
and experience to be used in <strong>the</strong> process at an early stage. The reason for this decision<br />
should also be recorded by <strong>the</strong> LEA on Elmer.<br />
8.4.8 In conducting such an initial prioritisation and consciously allowing a number <strong>of</strong> SARs<br />
not to be developed, <strong>the</strong>re is <strong>the</strong> potential risk that information contained within a SAR is<br />
not picked up or made use <strong>of</strong> by ECB or by an LEA. This follows <strong>the</strong> approach taken by<br />
<strong>the</strong> TFT at ECB, whose role is to filter and enhance SARs disseminated to <strong>the</strong> National<br />
Terrorist Financial Investigation Unit (“NTFIU”). The TFT conducting <strong>the</strong> initial sifting<br />
and development is multi-agency comprising Police, HMC&E and <strong>the</strong> Security Service.<br />
In both <strong>the</strong> TFT case and under our recommendations, <strong>the</strong>re is and would be subsequent<br />
analysis <strong>of</strong> <strong>the</strong> SAR information to identify any fur<strong>the</strong>r linked or potentially high quality<br />
SARs which were not caught in <strong>the</strong> initial process.<br />
8.4.9 In <strong>the</strong> case <strong>of</strong> <strong>the</strong> TFT it was decided that although some suitable SARs might be missed,<br />
<strong>the</strong> end result was that <strong>the</strong> NTFIU would be provided with high quality intelligence that<br />
<strong>the</strong>y actually wanted and could use. The same analysis applies here, although would<br />
depend on ECB obtaining “buy-in” from <strong>the</strong> customer it is servicing (i.e. <strong>the</strong> LEAs in this<br />
instance).<br />
LEA responsibility for recording status <strong>of</strong> individual SARs<br />
8.4.10 LEAs should manage and record <strong>the</strong> status <strong>of</strong> all SARs in <strong>the</strong>ir queue. Each SAR should<br />
be identified as being ei<strong>the</strong>r open, intelligence only or complete and confirming <strong>the</strong> status<br />
for open SARs on a rolling monthly basis:<br />
• Open SARs will be those where <strong>the</strong> LEA is conducting fur<strong>the</strong>r research, where <strong>the</strong><br />
LEA has requested a developed intelligence package from ECB, or is conducting an<br />
investigation using <strong>the</strong> SAR.<br />
• Intelligence only SARs will be those which <strong>the</strong> LEA does not want to work on, ei<strong>the</strong>r<br />
from a review <strong>of</strong> <strong>the</strong> SAR or once an investigation or fur<strong>the</strong>r research has been<br />
completed. Elmer should prompt <strong>the</strong> LEA to record details <strong>of</strong> any work conducted on<br />
a SAR or confirm that none was performed before it can be marked as intelligence<br />
only. Once marked as intelligence only, <strong>the</strong> contents <strong>of</strong> a SAR will be available to<br />
anyone through an Elmer search.<br />
• Complete SARs will be those where an investigation has taken place and a conclusion<br />
reached. Elmer should prompt <strong>the</strong> LEA to record details <strong>of</strong> any work conducted on a<br />
SAR, and <strong>the</strong> results <strong>of</strong> an investigation (including <strong>of</strong> any prosecution or<br />
confiscation) before it can be marked as completed. Once marked as completed, <strong>the</strong><br />
contents <strong>of</strong> a SAR will be available to anyone through an Elmer search.<br />
