Item Florida Governmental Utility Authority Board Agenda ltem Thu rsday, January L9, 2OL2 PH1 Public Hearing to Consider Approval of Resolution 2OL?-LO Amending the Previously Approved Rate Resolution for the North Fort Myers Utility System; Approval of North Fort Myers Reclaimed Water Action Plan Summary The FGUA staff has been working to develop an action plan for FGUA Board consideration regarding the reclaimed water (effluent spray irr¡gation) system in North Fort Myers to address a number of operational and financial matters. The attached report outlines the challenges facing the reclaimed water system in North Fort Myers, and recommends a number of actions for the FGUA Board consideration. L) These proposed actions include the implementation of charges for reclaimed water to existing customers, as well as a suggestion to utilize an interim or phase-in rate for the first several months. The FGUA currently receives revenue from one reclaimed customer (City of Cape Coral), and it is felt that time will be needed for the other customers to adjust to the new charges. ln order for the Board to be able to conslder these actions, an amendment to the recently approved rate resolution and rate schedule is required. The attached Resolution 2OL2-LO includes the following changes to the rate schedule for the North Forl Myers system: a) Clarifies that the reclaimed water rate applies to entire Nofth Fort Myers service area and not specifically to the Pine Lakes Area; b) Adopts a temporary "phase-¡n" rate of $0.1411000 gallons for the period of March 1, 2Ot2Through September 30, 2Ot2 lo be charged to ex¡sting Reclaimed Water customers who are being charged for the first time for this service; c) Adds language to the rate schedule which allows the FGUA Board of Directors to authorize an alternate rate for Reclaimed Water from the rate identified in the rate schedule, if it is related to a negotiated Reclaimed Water agreement with the FGUA, whereby the Reclaimed Water customer provides a tangible benefit to the North Fort Myers Reclaimed Water system (i.e. wet weather storage), such that a monetary credit or adjustment to the Reclaimed Water customer is both reasonable and appropriate. 2) The other recommended actions for FGUA Board consideration are: a) Authorize necessary capital project to test, repair or replace all reclaimed water meters, and to install appropriate automated contro¡ mechanisms. Staff will finalize the project scope, obtain cost estimates, and prepare necessary work authorizations and budget/ClP modifications to expeditiously move forward with these improvements. A preliminary cost estimate for the capital project is $21-5,000. The work authorizations and budget amendments will be presented to the Board at a future Board meeting. b) Authorize FGUA staff to initiate discussions,/renegotiation of agreements with reclaimed water customers to review and refine actual resource needs, commitments, and potential credits for receiving and storing reclaimed water duringthe wetseason. The goal isto complete the review and potential renegotiation of these agreements byJuly L.2042. 3) Establish and implement an FGUA policy to allocate reclaimed water resources with priorìty being determined as follows: o Priority 1 - Customers with reclaimed water agreements where the FGUA is committed to provide a specific quantity of reclaimed water. o Priority 2 - Customers with reclaimed water agreements, but with no specific quantity being committed by the FGUA. o Prioritv 3 - Customers without reclaimed water agreements.
