lf the Board elects to accept the setuement claims, once received, the proceeds should be deposited in the
appropriate utility system account for which they were generated. once the claims are filed later this month
Counsel can work with the finance department to establish where exactly the monies should go. This is
particularly important for systems the FGUA no longer owns as monies attributable to those systems may
need to be prorated between owners. ln order to participate in this settlement, the FGUA must file an
Election to participate and Release by January 3, 2Ot2. Ms. Encinosa recommended approval for her to
proceed with the proposed settlement with Bank of America'
