lf the Board elects to accept the setuement claims, once received, the proceeds should be deposited in the<br />

Counsel can work with the finance department to establish where exactly the monies should go. This is<br />
particularly important for systems the <strong>FGUA</strong> no longer owns as monies attributable to those systems may<br />
need to be prorated between owners. ln order to participate in this settlement, the <strong>FGUA</strong> must file an<br />
Election to participate and Release by January 3, 2Ot2. Ms. Encinosa recommended approval for her to<br />
proceed with the proposed settlement with Bank of America'<br />
