Intellectual Property<br />
If the application is approved, the IPO will notify the applicant<br />
or representative of the approval <strong>and</strong> send the trade mark to a<br />
designated daily newspaper for publication. That newspaper will<br />
contact the applicant or representative <strong>and</strong> request payment of the<br />
publication fee.<br />
Trademarks are published every Wednesday in a daily newspaper.<br />
Third parties may oppose the trade mark application within three<br />
months of its publication. After the expiry of the three-month period,<br />
if no oppositions were received, the Certificate of Registration is<br />
issued upon payment of the Certificate Fee <strong>and</strong> the registration<br />
can take approximately twelve to eighteen months. If a Notice of<br />
Opposition is received, the applicant <strong>and</strong> the opponent must file<br />
various documents <strong>and</strong> an opposition hearing is convened for a<br />
final determination of the matter.<br />
A single application may be used for multiple classes of goods <strong>and</strong><br />
services.<br />
Priority Application<br />
These can be made provided that the earlier application was filed in<br />
a country that is a party to the Paris Convention <strong>and</strong> an application<br />
for the same mark <strong>and</strong> the same goods or services is filed in <strong>Trinidad</strong><br />
<strong>and</strong> <strong>Tobago</strong> within six months of the filing of the application in the<br />
foreign country. A certified copy of the earlier application must be<br />
filed at the Intellectual Property Office within three months of filing<br />
the application for the same mark at the Intellectual Property Office.<br />
How is the registration process?<br />
If there are no corrections to be made to the application <strong>and</strong> no<br />
opposition to the application, the mark will be registered within six<br />
