52 私 隱 專 員 公 署 年 報 2006-07 法 律 工 作公 署 對 建 議 中 的 法 例 所 作 的 評 論Comments on Proposed Legislation by the PCPD非 應 邀 電 子 訊 息 條 例 草 案公 署 在 審 閱 草 案 後 , 向 工 商 及 科 技 局 局長 ( 下 稱 「 局 長 」) 提 出 下 述 意 見 :Unsolicited Electronic Messages (“UEM”) BillIn the course of discharging the duty to examine the Bill, the PCPD gavethe following comments to the Secretary for Commerce, Industry andTechnology Bureau (“the Secretary”): -1. 選 擇 不 接 收 機 制草 案 建 議 非 應 邀 電 子 訊 息 的 發 訊 人必 須 給 予 清 楚 顯 明 的 陳 述 , 讓 收 訊人 提 出 取 消 接 收 要 求 , 拒 絕 對 方 再 發送 非 應 邀 電 子 訊 息 , 而 收 到 取 消 接 收要 求 的 人 士 應 妥 善 保 存 有 關 要 求 至 少7 年 。 私 隱 專 員 提 醒 局 長 留 意 保 障 資料 第 2(2) 原 則 下 的 保 留 資 料 規 定 ,草 案 應 盡 可 能 減 低 保 留 資 料 的 類 別 及種 類 。1. The opt-out regimeIt was proposed under the Bill that senders of UEM would be obliged togive clear and conspicuous statements to enable the recipients to sendunsubscribe requests to refuse further UEM from being sent and that theperson to whom the unsubscribe request was sent should keep properrecord of the request for at least 7 years. The Secretary was remindedof the retention requirement under Data Protection Principle (“DPP”)2(2) and that the type and kind of information to be so retained shouldas far as practicable be narrowed down under the Bill.2. 同 意 使 用 電 子 地 址草 案 確 認 登 記 使 用 者 有 權 同 意 非 應 邀電 子 訊 息 的 發 訊 人 使 用 其 電 子 地 址 。草 案 中 「 同 意 」 的 定 義 包 括 他 人 代 該 登記 使 用 者 給 予 的 同 意 。 這 會 引 起 對 個人 資 料 私 隱 的 關 注 。 私 隱 專 員 建 議 ,除 非 有 合 理 理 據 支 持 , 否 則 最 好 只 由資 料 當 事 人 給 予 同 意 。2. Consent for using electronic addressThe Bill recognized the right of a registered user to give consent to theuse of his electronic address by the sender of UEM. The definition of“consent” under the Bill included a consent given by a person on behalf ofthe registered user. This would give rise to personal data privacy concern.The Privacy Commissioner suggested that it would be preferable thatconsent should only be given by the data subject, unless there werevalid grounds justifying the otherwise.
