The procedure for making suchan application was set out in the consequential amendments to theRules of the High Court, Cap.4 whereby a new Order 71A was proposed.The proposed Order 71A was similar to the existing Order 71 which regulatedthe application for registration of foreign judgments under the ForeignJudgments (Reciprocal Enforcement) Ordinance, Cap.319. However, theproposed Order 71A contained an additional requirement under its Rules3(2)(a) and (b) requiring the judgment creditor to exhibit his Hong Kongidentity card or his identification document to the supporting affidavit.依 據 建 議 的 第 71A 號 命 令 , 如 法 庭 指 令 判定 債 權 人 向 判 定 債 務 人 送 達 傳 票 , 附 有判 定 債 權 人 身 份 證 明 文 件 作 為 證 物 的 誓章 , 便 會 由 有 關 當 局 的 職 員 及 負 責 送 達的 代 理 人 處 理 , 並 向 判 定 債 務 人 送 達 。因 此 , 判 定 債 權 人 要 承 擔 身 份 證 明 文 件內 的 個 人 資 料 遭 濫 用 的 風 險 。If, pursuant to the proposed Order 71A, a judgment creditor is directedby the Court to serve a summons on the judgment debtor, the judgmentcreditor’s affidavit exhibiting a copy of the judgment creditor’s identificationdocument would be handled by the staff of the relevant authorities andagents responsible for service and served on the judgment debtor. Thejudgment creditor would therefore be exposed to risks of his personal datacontained in the identification document being abused.私 隱 專 員 因 此 請 律 政 司 司 長 提 供 在 草 案中 訂 立 此 項 規 定 的 理 據 , 並 解 釋 為 何 此項 規 定 只 適 用 於 登 記 內 地 判 決 的 申 請 。The Privacy Commissioner therefore invited the Secretary for Justiceto provide the basis for justifying the imposition of such requirementin the Bill and why it would only apply to application for registration ofMainland judgments.在 年 報 期 內 , 草 案 並 無 進 展 。There has been no further development during the period under review.
