38. CUSTODIANS OF CRICKET PROGRAM[a] Before captaining a team a player shall complete the Custodians of <strong>Cricket</strong> program, which will be offeredbefore the start of the season and, as necessary, during the season.[b] The Grade Secretary will maintain a database of captains who have completed the Custodians of <strong>Cricket</strong>program.[c] Competition points will not be allocated for any match in which a team is captained by a player that has notcompleted the Custodians of <strong>Cricket</strong> program.[d] This Regulation applies to First Grade, The Alan Pettigrew, Norm McMahon, Bob Spence, Roy Tanner, WEPHarris, Katherine Raymont and Second Grade Shields and The Under 18 Competition.39. CODE OF BEHAVIOUR – Refer to Policies AppendixALL PLAYERS AND OFFICIALS SHOULD BE WELL AWARE OF THE STANDARDS EXPECTEDAND CONSEQUENTLY ANY PLAYER OR OFFICIAL WHO BREACHES THIS CODE CANEXPECT LITTLE SYMPATHY IF FOUND GUILTY.40. PENALTY TO PLAYERS/OFFICIALS/CLUBS[a] Should any player or official commit any breach of these Regulations, including the Code of Behaviour, theIntoxicated Player Policy or the Racial and Religious Vilification Code the Conducts Commissioner or theConducts Committee may fine the offender, suspend them from further play, or otherwise deal with them at itsdiscretion. This may include suspended sentences which are subject to conditions imposed at the time ofsentence.[b] Should any Club commit any breach of these Regulations, the Grade Committee may fine the offending Club,suspend the Club or its team from further play, or otherwise deal with the Club at its discretion.[c] SCOPE OF PENALTIES[i] Penalties imposed by a Conducts Commissioner, Conducts Committee or an Appeals Tribunal, aredeemed to pertain to all cricket matches and competitions conducted or participated in by <strong>Queensland</strong><strong>Cricket</strong> and any of its affiliates for the duration of the penalty.[ii] Players suspended for breaches of <strong>Cricket</strong> Australia or ICC Codes are also deemed to be suspendedfrom all matches and competitions conducted, under the jurisdiction of or participated in by<strong>Queensland</strong> <strong>Cricket</strong> and any of its affiliates for the duration of the penalty.41. DISPUTES REFERRED[a] Any protest from a Club, or any matter of dispute between Clubs, shall be adjudicated upon by the GradeCommittee after all Clubs concerned have been notified of such protest or dispute and have had the opportunityof making written representations thereon, provided that no such protest or dispute shall be considered by theGrade Committee unless lodged with the Grade Secretary of <strong>Queensland</strong> <strong>Cricket</strong> within seven [7] days after thematter in question arose, provided that in all cases in dispute any player or Club may appeal to the <strong>Queensland</strong><strong>Cricket</strong> Appeals Tribunal within fourteen [14] days of the date of the Grade Committee decision and its decisionthereof shall be final.[b] In relation to all appeals to the <strong>Queensland</strong> <strong>Cricket</strong> Appeals Tribunal from any decision of the Grade Committeeunder this Regulation, the process identified under the Appeals Regulation shall apply.42. GRADE COMMITTEE POWERS[a] In the event of a breach of the Regulations governing Grade Competition matches and/or in respect of anyaction, conduct, behaviour or decision taken, made or implemented by any Club, player, official or otherrepresentatives of the Club by, through or in connection with any Grade Competition match which in theopinion of the Grade Committee, constitutes conduct or action detrimental to the game or the spirit of the game,the Grade Committee may impose on a Club such a penalty as the Grade Committee considers appropriate in thecircumstances.[b] Without limiting the generality of paragraph [a] above, the penalty may include any of, or any combination of,the following:[i] forfeiture of the Match, Bonus and/or Incentive Points gained by the Club in the particular competitionmatch or matches;[ii] in the event of a Semi Final or Final, forfeiture of the match;[iii] a monetary penalty.43. ALTERATIONS TO REGULATIONSNo existing Regulation shall be appealed or altered nor shall any new Regulation be added without theconcurrence of a majority of the persons then present and entitled to vote and voting at a meeting of the GradeCommittee. If necessary the Chairman of the meeting shall have the casting vote.31
