æmCITY OF I UPPER ARLINGTONCIVIL SERVICE COMMISSIONMEETING MINUTESAugust 14,2012The meeting of the Upper Arlington Civil Service Commission was called to orderby Anne Croskey at 7:01 pm in the Council Committee Room of the MunicipalServices Center, 3600 Tremont Road, all members having been notified andpublic notice having been given according to law.MEMBERS PRESENT: Lisa BurlesonMidge SlemmerAnne CroskeyALSO PRESENT: Julie Williams, Commission SecretaryTom Lindsey, Assistant City AttorneyApprove June 12. 2012 meeting minutes. (Rule 4 G)Motion: Midge Slemmer moves to approve the minutes as presented. Lisa Burlesonseconds.Motion carried unanimously to approve the June 12, 2012 minutes as amended toreflect the change in the word "motions" to "moves" following the Executive Session.Discuss the procedures for appeal hearings.Changes as discussed to be amended by Tom Lindsey as follows.. The orders of Appellant's Case and Respondent's Case are reversed.. Testimony from Potentially Aggrieved Parties is deleted.. Rebuttal of Appellant is changed to Rebuttal of Respondent.. Language as follows is added to the Closing Statements. "Commission has thediscretion to request written post-hearing briefs and to defer deliberation anddecision as needed."Changes as recommended are documented below.4. Respondent's Casea. Respondent Rebuttal ClosingCommission has the discretion to request written post-hearing briefs and to defer deliberationand decision as needed.Continue the discussion of the proposed changes to Civil Service Rules #7-13(Rule 17 A)Rule 7 E.Lisa Burleson questions the word "not", as underlined. Lisa inquires if this is a proposedchange. Upon review of current rules, this is a change. Previous language allows forthe probationary period to be included in determining the minimum time. Tom Lindseywill investigate further to clarify the reason for this change before an approval to thechange is made.Rule 9 B. 1Anne Croskey questions paragraph 1 which states "When less than ten (10) names arecertified to an Appointing Authority, appointment from the list shall not be mandatory."Paragraph 2 states "But in the event that ten or fewer names are on the eligible list, theappointing authority may select any of the listed candidates." Tom will clarify if theintent is to have the option to call for a new list and will consider adding new language.Rule 9 E. 4Midge Slemmer suggests an amendment to include the word "business" to reflect"within three (3) business days."Rule 9 J. and K.Lisa Burleson questions and the uses of the words permanent, temporary, andprovisionaL. Lisa suggests and Tom concurs with the following changes to 9 J. and K.Strike the words "or provisional". Tom and Lisa also both agree to remove "as opposedto temporary" - striking part of the sentence in 9 J.Rule 9 K.Anne Croskey suggests and Tom Lindsey agrees with adding the word "however" underto read "However, a person appointed to a promotional position in the Police of FireDepartment under this rule shall not achieve permanent status merely by serving in theposition."Rule 9 L.Lisa Burleson makes the suggestion and Tom Lindsey agrees to change the title toremove the word "Emergency".Rule 10 A. 2.Tom Lindsey brings to attention the typo. A comma will be added to read "To extend theprobationary period, the Appointing Authority must notify the employee prior to the

original probationary period termination date."Rule 11 B. 2.Midge Slemmer questions language "without further training" and whether this mayconflict with bargaining agreements. Tom Lindsey will investigate any possiblebargaining agreement conflicts.Tom Lindsey reports that he will make changes to the Civil Service Rules asdocumented and send to the Commission Members to review. Commission Membersmay email separately any questions they may have.
