Then onMay 24, a judge dismissed Lauzon’srequest to delay handingover the document until the appealhad been heard, effectivelydismissing the appeal related tothe engineering report.Lauzon is still appealing thejudge’s ruling for it to complywith making its building safeand meeting the heritage requirementsassociated with 287Cumberland St.The saga began when Lauzonfiled an application to OntarioSuperior Court on Feb. 20 askingfor permission to tear downthe building at 287 CumberlandSt., which has remained in disrepairfor decades. The applicationstates the city has knownsince 2005 that the building has“significant structural concerns”and did nothing. Groupe ClaudeLauzon wants to tear the schooldown and put up condos, butthe city refused the company’sdemolition application in 2006because Lauzon did not provideplans for what it plannedto build on the site, which is arequirement of the heritage districtpolicies that apply to theneighbourhood.Lauzon received the engineeringreport in question onFeb. 1, and that set off the latestchapter in the troubled relationshipbetween the developer andthe city. The school was unsafefor inspectors to enter, andtherefore the city’s building inspectorscan’t make any orders,the application states.
