10.2 Full-time employment<strong>Broadcasting</strong> <strong>and</strong> <strong>Recorded</strong> <strong>Entertainment</strong> <strong>Award</strong> <strong>2010</strong>(a)(b)Except as specified elsewhere in this award a full-time employee is anemployee who is engaged to work 38 hours per week.A full-time employee must be provided with a written statement setting outtheir classification, applicable pay scale <strong>and</strong> terms of engagement.10.3 Part-time employment(a)(b)(c)(d)(e)A part-time employee is an employee who works less than 38 hours; hasregular, reasonably predictable <strong>and</strong> continuous employment; <strong>and</strong> receives, on apro rata basis at the rate of 1/38th of the weekly rate, equivalent pay <strong>and</strong>conditions to those of full-time employees who do the same kind of work.An employer is required to roster a part-time employee for a minimum of fourconsecutive hours on any day or shift.At the time of engagement, the employer <strong>and</strong> the part-time employee will agreein writing on a regular pattern of work, specifying at least the hours workedeach day including the starting <strong>and</strong> finishing time <strong>and</strong> which days of the weekthe employee will work. A copy of the agreement must be provided to theemployee.The terms of the engagement may be varied by consent. Any agreed variationto the pattern of work will be recorded in writing, with a copy of the variationprovided to the employee.All hours worked in excess of the hours as mutually arranged will be overtime<strong>and</strong> will be paid as such.10.4 Despite clause 10.3(c), the hours of a television journalist may be altered by theemployer giving the employee seven days’ notice in writing, provided that there is nochange to the total agreed number of ordinary hours of work.10.5 Casual employment(a)(b)(c)(d)A casual employee is an employee engaged as such <strong>and</strong> paid by the hour. Anemployer when engaging a casual must inform the employee that they areemployed as a casual, of their hours of work, classification level <strong>and</strong> rate ofpay.A casual employee must be paid at the relevant minimum hourly wage plus aloading of 25%. Such loading is paid instead of all paid leave including annualleave, personal/carer’s leave <strong>and</strong> public holidays not worked whetherprescribed in this award or the NES.Casual employees must be paid at the termination of each engagement, butmay agree to be paid weekly or fortnightly.Subject to the provisions of clause 14.7, casual employees are entitled to aminimum payment of four hours’ pay on each occasion they are required toattend for work.12 MA000091
