<strong>Broadcasting</strong> <strong>and</strong> <strong>Recorded</strong> <strong>Entertainment</strong> <strong>Award</strong> <strong>2010</strong>(a)(b)Up to <strong>and</strong> including the first hour of overtime will either be given as time offinstead of payment, at the rate of time <strong>and</strong> a half, within the following fortnightor paid for at the rate of time <strong>and</strong> a half, at the discretion of the employer.Overtime in excess of one hour will be paid for at the rate of time <strong>and</strong> a half forthe first hour <strong>and</strong> double time after that.[52.3(c) varied by PR994431 from 01Jan10](c)(d)(e)An employee may, by mutual agreement with their employer, opt to takeovertime as time off instead of payment at the rate of single time within thenext 12 months. Such agreement will be recorded in writing.Any time allowed off duty instead of overtime will be deemed to be ordinaryhours for the day or days on which the time off instead is taken.When an employee is not given the days or nights off duty as provided for inclause 45—Hours of work the employee will be paid at the rate of double timefor all work done on any such day or days with a minimum payment for fourhours.52.4 Insufficient break represents all time worked before the expiration of 12 hours fromthe completion of duty on one day <strong>and</strong> the resumption of duty, except during distantengagements, <strong>and</strong> will be compensated as follows:(a)(b)if the break is less than eight hours, overtime will be paid for at the rate ofdouble time for all work done before the expiration of the 12 hour break; orif the break is eight hours or more, overtime will be paid for at the rate of time<strong>and</strong> a half for all work done before the expiration of the 12 hour break.52.5 If an employee is called upon to resume duty within 12 hours of completion of adistant engagement, overtime will be paid at the rate of time <strong>and</strong> a half for all workdone before the expiration of the 12 hour break.52.6 Time worked during any period of insufficient break will not be included in thecalculation of weekly hours.52.7 In no circumstances will overtime as provided for in this clause be compensated formore than once.52.8 Notwithst<strong>and</strong>ing the above, overtime on a distant engagement will be governed byclause 50—Distant engagements.Part 9—Cinemas53. Ordinary hours of work <strong>and</strong> rostering53.1 Hours of work—other than managers(a)Ordinary hours of work can be any hours worked on any of the days Mondaythrough to <strong>and</strong> including Sunday provided that ordinary hours worked between1.00 am <strong>and</strong> 8.00 am on any day will be paid at the rate of double time.MA000091 55
