Plans for new guidelines and standards, or guidelines and standards underpreparati<strong>on</strong>, primarily focus <strong>on</strong> describing services in <strong>the</strong> form of catalogues <strong>on</strong> <strong>the</strong><strong>on</strong>e hand and <strong>the</strong> related quality and c<strong>on</strong>tinuity standards <strong>on</strong> <strong>the</strong> o<strong>the</strong>r, in particularregarding links between inpatient and outpatient services and across different serviceproviders (see Chapter 5.2).11.3 Implementati<strong>on</strong> processImplementati<strong>on</strong> of <strong>the</strong> aforementi<strong>on</strong>ed standards by <strong>the</strong> attending doctors andaddicti<strong>on</strong> treatment and support services is voluntary because, with <strong>the</strong> excepti<strong>on</strong> ofdecrees and organisati<strong>on</strong>al guidelines, <strong>the</strong>y are mere recommendati<strong>on</strong>s. Therefore <strong>the</strong>authorities in charge (i.e., public health officers, Ministry of Health, Vienna Addicti<strong>on</strong>and <strong>Drug</strong> Coordinati<strong>on</strong> Office) <strong>on</strong>ly supervise adherence to <strong>the</strong> provisi<strong>on</strong>s of <strong>the</strong>obligatory organisati<strong>on</strong>al guidelines and decrees. In Carinthia, a guide has beenpublished to assist public health officers, which lists competences regarding individualprovisi<strong>on</strong>s of <strong>the</strong> Narcotic <strong>Drug</strong>s Decree as well as ways of ensuring whe<strong>the</strong>r doctorsdelivering OST meet <strong>the</strong> corresp<strong>on</strong>ding regulati<strong>on</strong>s (Amt der Kärntner Landesregierung2007b). The activities undertaken to safeguard c<strong>on</strong>sistency in <strong>the</strong> executi<strong>on</strong> of <strong>the</strong>Decree primarily focus <strong>on</strong> informati<strong>on</strong> and communicati<strong>on</strong> of knowhow by means offur<strong>the</strong>r training schemes. For this purpose, quality circles have been established,am<strong>on</strong>g o<strong>the</strong>r fur<strong>the</strong>r training events.The Act <strong>on</strong> Doctors (BGBl I 1998/169, latest amendment published in BGBl I 2009/144)obliges doctors to treat diligently and without distincti<strong>on</strong> any pers<strong>on</strong>, ei<strong>the</strong>r healthy orill, who turns to <strong>the</strong>m for medical advice or treatment. In additi<strong>on</strong>, doctors shallregularly take part in recognised fur<strong>the</strong>r training programmes organised by <strong>the</strong>Provincial or Austrian Medical Associati<strong>on</strong>s or in recognised fur<strong>the</strong>r trainingprogrammes of o<strong>the</strong>r countries and, according to <strong>the</strong> state of <strong>the</strong> art of medicine andpractical experience, while meeting any applicable regulati<strong>on</strong>s and professi<strong>on</strong>al qualitystandards, restore <strong>the</strong> wellbeing of <strong>the</strong> sick and protect <strong>the</strong> healthy (Act <strong>on</strong> Doctors,Secti<strong>on</strong> 49, Para. 1). The detailed regulati<strong>on</strong>s for substituti<strong>on</strong> treatment, as provided by<strong>the</strong> Decree of 2007 issued <strong>on</strong> <strong>the</strong> basis of Secti<strong>on</strong> 10, Para. 1 No. 5 of <strong>the</strong> NarcoticSubstances Act, were regarded as too restrictive by <strong>the</strong> doctors, arguing that thislimited <strong>the</strong>ir competences defined by <strong>the</strong> Act <strong>on</strong> Doctors. The modificati<strong>on</strong>s laid downin <strong>the</strong> amendment to <strong>the</strong> Decree <strong>on</strong> Narcotic <strong>Drug</strong>s adopted late in 2009 as a result ofexperience with <strong>the</strong> existing Decree (see GÖG/ÖBIG 2008c and 2009b as well asChapter 5.1) have increased <strong>the</strong> doctors' acceptance. What c<strong>on</strong>tinues to bec<strong>on</strong>troversial is <strong>the</strong> fact that treatment-related decisi<strong>on</strong>s which are not in line with <strong>the</strong>Decree may still have legal c<strong>on</strong>sequences for <strong>the</strong> attending doctor in questi<strong>on</strong>.
